Louisville City Council Meeting <br />June 5, 2001 <br />Page 8 <br /> <br />year only, with provisions to negotiate in good faith for a renewal next year. Phare stated <br />that the City Attorney has reviewed and approved the agreement. <br /> <br />Mayer asked if, given the City's pipeline limitation, is there any likelihood that the City <br />of Louisville could take possession of their entitled water at Windy Gap. Phare estimated <br />that there could be a 50/50 chance of taking possession of the water. He stated that he <br />was more orientated in taking the $200 acre-foot fee. <br /> <br />Mayer asked if the water would be conveyed to the north water treatment plant. Phare <br />confirmed that the raw water would be taken at the north plant. <br /> <br />Mayer asked Phare how the price was set for the leased water. Phare stated that he <br />attended a Windy Gap meeting and heard discussion that agricultural leasing of raw <br />water ranges between $30-$50 per acre-foot. <br /> <br />Howard asked if the water rights were being rented opposed to being sold. Phare stated <br />that it is a one-year lease of surplus return flows, which the City has the right to use and <br />reuse at the Waste Water Plant. <br /> <br />Davidson stated that there are advantages for the City, and noted that the water is <br />currently being put in the creek without any return. He stated that Erie could be <br />competing with the City to purchase shares of CBT water. He stated that this was a <br />win/win situation for both communities. <br /> <br />Mayer concurred with the comments of Mayor Davidson, however he noted that there is <br />a clause for renewing the lease in future years. He asked City Attorney Light if the City <br />is agreeing to terms over and above the one-year period of the lease. Light stated that it <br />is a one-year lease, and that it was his interpretation that there may be discussions after <br />one year. He stated that any agreement over one-year would require an ordinance. <br /> <br />MOTION: Sisk moved that Council approve the lease of reuse water to the Town of <br />Erie, seconded by Brown. Roll call vote was taken. The motion passed by a vote of 7-0. <br /> <br />None. <br /> <br />CITY ATTORNEY'S REPORT <br /> <br /> CITY ADMINISTRATOR'S REPORT <br /> <br />City Administrator Simmons reminded Council of the Tuesday, June 10, 2001 work <br />session and noted that one item of discussion is the status of the Via Appia underpass. <br /> <br /> <br />
