Louisville City Council Meeting <br />June 19, 2001 <br />Page 4 <br /> <br />owners, is requesting an amendment to the IGA to allow this request to move forward. <br />Consideration of a plan amendment to the IGA would be required during the public <br />hearing process. Wood stated that the referral was sent to the Northwest Parkway on <br />January 4, 2001, and responses have been received from the IGA jurisdictions. <br /> <br />Davidson called for applicant presentation. <br /> <br />Mr. Richard Lopez, 4450 Arapahoe Avenue, Boulder, CO, attorney and planner <br />representing the owners, reviewed that the annexation proposal is in substantial <br />compliance and that all the statutory requirements have been met. He stated that this <br />annexation will serve the public interests of the City of Louisville as development is <br />planned on three sides of the property. He addressed the position that Lafayette has taken <br />with respect to the amendment to the Northwest Parkway IGA, and stated that at the time <br />of their initial response, there was pending litigation in the Paradise Lane lawsuit. He <br />noted that the lawsuit has been finalized and is no longer an issue, therefore, the request <br />for an amendment to the IGA can proceed. He stated that with respect to Boulder <br />County's request for the City to designate additional land for rural preservation, that is a <br />matter for the City of Louisville to decide. He stated that the de-annexation of a certain <br />amount of land zoned Industrial for Rural Preservation would satisfy Boulder County's <br />concerns. <br /> <br />COUNCIL COMMENT <br /> <br />Sisk asked Mr. Lopez the basis of his submittal of a letter to I.K. & Virginia Hoyle, dated <br />March 24, 1980, and written by City of Louisville Community Development Director <br />John Rupp. Lopez stated that the letter was in the possession of the Hoyle family and <br />represents that the Hoyle property is in fact an enclave. <br /> <br />Sisk asked Mr. Lopez if he was suggesting that the letter offers to annex the property <br />subject to the Hoyle's acceptance. Lopez stated that it could be considered an offer, <br />which was not responded to. <br /> <br />Sisk commented that the letter represented the position of the City of Louisville in 1980 <br />and asked if the Hoyle's had submitted any requests for annexation prior to last year. <br />Lopez stated that the Peak-to-Peak Charter School had filed a petition that he believed to <br />be the same property. <br /> <br />Brown commented on the Boulder County letter for a one-to-one replacement of rural <br />preservation and asked what options are available for the City. Planning Director Wood <br />stated that he has not identified any parcels that meet the criteria to be further restricted <br />by inclusion in an IGA. He stated his opinion that it would require undesignated <br />properties be brought into an IGA to accomplish a one-to-one ratio. <br /> <br />4 <br /> <br /> <br />
