Louisville City Council Meeting <br />July 3, 2001 <br />Page 4 <br /> <br />Sisk noted that the Planning Commission has continued the Maurer property zoning until <br />July 10, 2001 and has not made recommendation to Council. <br /> <br />Davison stated that the ordinances for Maurer Annexation and Zoning are the first <br />readings. <br /> <br />City Attorney reviewed the procedural options available to Council on Resolution No. <br />30, Ordinances 1362 and 1363, Series 2001. He noted that a public hearing has been <br />advertised for July 3, 2001 for the annexation and zoning of the property and the <br />Planning Commission has not made recommendation on the zoning of the property. He <br />stated that one option would be to proceed with the annexation and zoning hearing, or <br />wait until the Planning Commission forwards a recommendation on the zoning. He <br />stated that another option would be to open the annexation public hearing and include <br />that hearing or open the annexation and zoning public hearing and continue the hearings <br />until another meeting. Light stated that under the annexation statute, one hour of <br />testimony is required before continuing the annexation. If the issues relate only to the <br />zoning, there is an option of withholding the annexation until the zoning has been <br />established. <br /> <br />Planning Director Wood reviewed Ordinance No. 1362, Series 2001, first reading, <br />approving an annexation known as the Maurer Annexation. He stated that Ordinance No. <br />1362, Series 2001, if authorized, annexes a 1.156-acre parcel known as the Maurer <br />annexation. He reported that the landowners, James A. and Kaylyn Maurer are <br />petitioning the City to commence a voluntary annexation for their property located <br />approximately 600 feet east of the intersection on S. 88th Street and Dillon Road. He <br />stated that the subject property is not an enclave and has 59% contiguity with the City of <br />Louisville, which exceeds the statutory requirement. <br /> <br />Wood reviewed that the property is undeveloped, triangularly shaped with approximately <br />398 feet on linear frontage on the Dillon Road fight-of-way, 276 feet along the west <br />property boundary adjacent to the Coal Creek Ranch Filing #4 Subdivision. He stated <br />that the other portion of the triangle is approximately 400 feet to the north, which fronts <br />two outlots, plotted in conjunction with Coal Creek Filing #4. Outlots E and I are <br />adjacent to one another, between St. Andrews Lane and the subject property. Outlot E <br />was dedicated to the City of Louisville and maintained by the Home Owners Association <br />of Coal Creek Ranch. Outlot I was dedicated to and maintained by the Home Owners <br />Association. Wood stated that there is approximately a 12 to 15% slope across the <br />property falling from the southeast to the northwest. <br /> <br />Wood stated that the applicant has requested as a condition of annexation, the City <br />convey an access easement across Outlot E (City outlot) to provide access to the subject <br />property from St. Andrews Lane.
