He stated he could <br />easily go ahead with the show cause if needed and also could present past violation <br />evidence for the renewal hearing. He did not feel this would be good use of the <br />Authority's time given the unlikely pursuit of renewal per information he received from <br />the Mr. Rennich. <br /> <br />Mulvahill moved the Authority direct staff to prepare an order of denial on the renewal <br />application for Celtic Way d/b/a Druids Arms based on the failure to the pay the renewal <br />fees and any applicable late renewal fee and the two matters pending and scheduled for <br />show cause hearing and the renewal hearing be continued until the next meeting date, <br />March 28, 2005 at 7:00 PM. Wilson seconded. Roll Call Vote: Wilson - yes, Mulvahill <br />- yes, Rommelfanger - yes and Koertje - yes. Motion carried. <br /> <br />B. Show Cause Hearing - Hei Han Enterprises, Inc. d/b/a Henry's Bar & Grill- <br />Tavern License - 935 Pine Street <br /> <br />Mr. Mark Shapiro, prosecutor for the Authority and Mr. Eric Johnson, attorney for <br />Henry's appeared before the Authority with a Stipulation and Agreement in this matter. <br />Mr. Shapiro reminded the Authority this was a continuance of a hearing from the last <br />meeting. He then clarified the dates of offenses included in the consideration of this <br />agreement. He stated he was ready to go to hearing if the Authority did not approve the <br />stipulation. There would be a total of eight days suspension served. <br /> <br />Mr. Johnson stated his client agreed to the agreement and has had his employees take <br />the server/seller training class. He asked the Authority to accept the stipulation and <br />have the days served from March 21-28,2005. <br /> <br />Wilson moved the Authority accept the stipulation and agreement, set the dates for <br />suspension for March 21-28, 2005 and authorize the chairperson to sign the Stipulation <br />and Agreement and Findings and Order. Rommelfanger seconded. Roll Call Vote: <br />Rommelfanger - yes, Mulvahill - yes, Wilson - yes and Koertje - yes. <br /> <br />C. Show Cause Hearings - The Back Room Brewery, Inc. d/b/a The Back Room <br />- Hotel and Restaurant License - 328 South McCaslin Blvd. <br /> <br />Mulvahill called the show cause hearing to order. Lipton arrives. <br /> <br />Stefan Fredricksmeyer, special prosecutor for the Authority and Thomas Newman, <br />owner of The Back Room entered their names for the record and stated they were <br />ready to proceed.
