<br />Louisville Local Licensing Authority <br />Meeting Date: February 28, 2005 <br />Page 6 of 7 <br /> <br />He indicated he had taken training to help identify when a person is intoxicated. He <br />testified he was dispatched on 9/28/04 to The Back Room concerning a disturbance. <br />Dispatch said a male employee of the establishment was being assaulted by an <br />intoxicated female. Officer Sundberg testified when he arrived at The Back Room, he <br />spoke with the female party (Kelly Wilson) and noticed she had bloodshot, watery eyes, <br />slurred speech and the smell of alcohol on her breath. He also spoke to Emily Hanson, <br />the bartender at The Back Room. His report reflected the bartender had served seven <br />drinks to Kelly Wilson. He then said he and another officer went to find Royce <br />Anderson, the male party involved in the incident. Anderson told Sundberg he and <br />Wilson had an argument because he didn't want her to drive as she was intoxicated. <br />Officer Sundberg reported he cited Emily Hanson, Royce Anderson and Thomas <br />Newman for Serving to Certain Persons Prohibited. <br /> <br />Jeffrey Hallock testified he had been called to The Back Room to take Kelly Wilson <br />home. He stated she was crying, visibly upset and had some visible bumps and <br />bruises. He didn't think she seemed intoxicated. <br /> <br />Emily Hanson testified Kelly Wilson was at the bar when she arrived for her work shift. <br />She stated she knew seven beers had been served to Kelly and thought another <br />customer had purchased a shot for Kelly during the approximately eight hours Kelly was <br />at the bar. She didn't feel Kelly was intoxicated at the time she served the last drink. <br /> <br />Officer Clifton Welter was called to the stand concerning the second incident. He <br />indicated he had taken training to help identify when a person is intoxicated. He stated <br />he was dispatched to The Back Room on 12/12/04 upon a report of a domestic violence <br />incident occurring at the location. During the time he and Officer Blackney were at The <br />Back Room conducting the investigation, David Dumas, a patron at the bar, stood up <br />and loudly exclaimed he wanted to question authority. Other patrons convinced David <br />to sit back down and not challenge the officers. The officers were then standing outside <br />the bar and Mr. Dumas walked by with his wife. Officer Welter asked Mr. Dumas how <br />much he had to drink. Officer Welter determined Mr. Dumas was intoxicated. Officer <br />Welter then talked to the bartender who said Mr. Dumas had been there for a couple of <br />hours and had a few beers. Officer Welter then issued a summons to Brian Donohue, <br />the bartender, for serving to a visibly intoxicated person. <br /> <br />Thomas Newman testified he had been bartending that night and had served Mr. <br />Dumas two Long Island Iced Teas and then cut him off. He then left the establishment <br />to take home two patrons and was gone approximately an hour. He learned of the <br />incident with the police and David Dumas after he returned. He asked Mr. Donohue <br />why he had gotten a ticket since he had not served Mr. Dumas.
