City Council <br /> Meeting Minutes <br /> March 19, 2013 <br /> Page 7 of 10 <br /> UNITS — Public Hearing <br /> Mayor Muckle opened the public hearing and requested a staff presentation. <br /> Planning Director Russ explained the Applicant, Garrett Mundelein, has requested an <br /> amendment to the Amended Parbois Place Final Planned Unit Development (PUD) to <br /> eliminate a requirement within the PUD to demolish the eastern most building on Lot 3 <br /> and request a second residential unit on Lot 3, increasing the total number of allowed <br /> units within the PUD to increase from 15 to 16 units. The original and the amended <br /> Parbois Place PUDs maintain a development restriction of 15 units based on the <br /> subdivision's total land area and the existing underlying Residential Medium Density <br /> (RM) Zone District allowed density. The 15 unit density requirement is tied to the <br /> demolition of the existing structure located on the property to ensure compliance. The <br /> PUD required the demolition of the eastern most building on Lot 3. The original Parbois <br /> Place PUD conditioned the release of the Certificates of Occupancy for Building 4 (Units <br /> 9 and 10) on Lot 4 to the demolition of the eastern most building on Lot 3 to ensure a <br /> 16th unit would not be constructed, or occupied within the subdivision. <br /> On January 8, 2013, the City Council removed the condition restricting the Certificates <br /> of Occupancy of Building 4 on Lot 4 to the demolition of the eastern most building on <br /> Lot 3, but not the elimination of the demolition requirement on Lot 3. The underlying RM <br /> zoning would allow two units on the property. The Parbois Place PUD redistributed the <br /> total allowed 15-units within the PUD, increasing the density of units toward Downtown <br /> Louisville and Elm Street while reducing density toward the residential neighborhood to <br /> the South. The PUD restricted Lot 3 to a single unit and established an approval date <br /> no later than 36 months after the date of Final Plat and PUD approval. The single family <br /> house on Lot 4 has been demolished, but the easternmost home on Lot 3 and the <br /> garage on Lot 6 have not been demolished. <br /> Public Land Dedication: The applicant previously satisfied this requirement by paying a <br /> 15% public land dedication fee. With this request, the applicant is not required to <br /> provide a 15% land dedication fee because the proposed action is not creating an <br /> additional ownership designation. However, since this lot has been platted, staff <br /> recommends approval be conditioned on payment of a public land dedication fee upon <br /> any future subdivision or creation of separate ownership for any portion of Lot 3. <br /> Staff recommended approval of Resolution No. 15, Series 2013, which increases the <br /> density from 15 units to 16 units within the Parbois Place Subdivision by allowing a <br /> second unit on Lot 3 with one condition: <br /> 1. A public land dedication fee shall be paid upon subdivision or creation of separate <br /> ownership for any portion of Lot 3 accordance with section 16.16.060 of the <br /> Louisville Municipal Code (LMC). <br /> COUNCIL COMMENT <br />
