City Council <br />Meeting Minutes <br />May 21, 2013 <br />Page 4 of 19 <br />Mayor Muckle opened the public hearing and requested a staff presentation. <br />Parks and Recreation Director Stevens explained the Colorado Department of <br />Transportation (CDOT) is in the process of planning and designing a project to widen <br />US 36 from 88th Street in Louisville, to Foothills Parkway in Boulder. This project is <br />known as Phase 11 of the US 36 Managed Lane /Bus Rapid Transit Project. CDOT <br />completed three Real Property Appraisal Reports purchases: Parcel 8A (S3 — US 36 <br />and McCaslin) Parcel 8B (Damyanovich) and Parcel 8C (Davidson Mesa). CDOT is <br />offering the City of Louisville $34,210 for Parcel 8A; $37,430 for Parcel 8B and <br />$32,264.66 for Parcel 8C. There is a precedent under these circumstances that the <br />conveyance does not require voter approval nor must it be finalized through <br />condemnation proceedings. The City may enter into an agreement to sell R.O.W <br />parcels to CDOT. <br />Subject to finalizing agreement with Boulder County on the sharing of Parcel 8B <br />proceeds, the City's Conservation Trust — Open Space and Parks Fund will receive <br />$86,249.66 for 113,941 square feet of real estate necessary to complete US 36 <br />Improvement Project. Staff recommended the City Council approve Ordinance No. <br />1631, Series 2013 on second and final reading. <br />COUNCIL COMMENTS <br />Council member Keany requested the funds be returned to the City's Conservation <br />Trust — Acquisition Fund for future purchases rather than used for open space <br />maintenance. City Manager Fleming stated the funds could be reserved for Land <br />Acquisition. Finance Director Watson confirmed the funds could be earmarked as a <br />Council designation to the Land Acquisition Fund. <br />Mayor Muckle referred to the maps, which illustrated the parcels in question, and noted <br />they are very small slivers of land. He voiced his support for the ordinance. <br />Council member Jasiak asked Council member Keany if his request is to earmark funds <br />specifically for open space or for open space and parks. Council member Keany <br />requested the funds be earmarked for land acquisition - open space and parks. <br />Mayor Muckle called for public comment and hearing none closed the public hearing. <br />MOTION: Council member Keany moved to approve Ordinance No. 1631, Series 2013 <br />on second and final reading, seconded by Council member Loo. <br />Mayor Pro Tem Dalton asked how the funds would be designated to the Acquisition <br />Fund. City Attorney Light explained Council could provide direction to the City Staff. <br />Mayor Muckle asked Council members Keany and Loo if the motion of approval may <br />
