City Council <br />Meeting Minutes <br />August 7, 2007 <br />Page 12 of 14 <br />David Kahn, 808 LaFarge Avenue, Louisville, CO voiced his appreciation for the <br />applicant's willingness to follc,w t;he conditions of the Special Review use. He <br />noted there are other noises lfrom other businesses in the neighborhood. <br />MOTION: Council member Muckle moved to approve Resolution No. 38, Series <br />2007, with the following three conditions: 1) The 6' fencing limit be stricken to <br />allow a higher fence; 2) The rear exit from the patio area be signed to indicate <br />the exit shall be utilized for emergency egress and delivery purposes only; 3) The <br />SRU be reviewed in 9-12 mo~~nths for consideration of any further mitigation, <br />seconded by Council member Yarnell. <br />Mayor Sisk offered a friendly amendment the fence be a minimum height of 6' <br />and not to exceed 8'. Counciil members Muckle and Yarnell accepted the <br />amendment. <br />Council member Marsella asked what procedures would be followed if a 9-12 <br />month review was made a condition of approval. Planning Director Wood <br />explained notice would be established and the SRU would be brought back <br />before the Planning Commission for their review and recommendation to Council. <br />City Attorney Durfee confirmE;d a 9-12 month review condition would be binding. <br />Mayor Sisk asked if an unintE;nded consequence of a 9-12 month review might <br />be to revoke the patio use. Planning Director Wood responded yes. <br />Mayor Sisk suggested in lieu of a 9-12 month review, a condition be added to <br />abide by the noise restrictiorns adopted by the Colorado Revised Statutes. <br />Council member Muckle withdrew the 9-12 month review condition from his <br />motion and replaced it with a condition that the applicant will abide with the noise <br />regulations adopted by the Colorado Revised Statutes. Council member Yarnell <br />accepted the amendment to 'the motion. <br />Planning Director Wood requested a condition that the Special Review Use is <br />granted to the applicant only. Council members Muckle and Yarnell accepted the <br />amendment. <br />VOTE: All in favor. Absent: Council member Sackett. <br />RESOLUTION No. 40, SERVES 2007 - A RESOLUTION APPROVING A FINAL <br />PLANNED UNIT DEVELOPMENT (PUD) FORA 6.60 ACRE PARCEL TO <br />SUBDIVIDE INTO LOT 1, LOT 2, AND CTC BLVD. RIGHT-OF-WAY. (1900 <br />CHERRY STREET) <br />Mayor Sisk requested a Stafif presentation. <br />
