City Council <br />Meeting Minutes <br />August 7, 2007 <br />Page 13 of 14 <br />Planning Director Paul Wood explained the applicant, Etkin Johnson, is <br />requesting authorization of a Final subdivision plat and PUD development plan as <br />required for the future phased development of a two lot subdivision. The final <br />PUD development plan proposes the construction of a phased, speculative, flex <br />building on proposed Lot 1, with the development of a water quality and storm <br />water detention facility on the easterly lot, Lot 2. The Subdivider proposes to <br />dedicate the required right-of--way, and construct the last segment of CTC <br />Boulevard, which would connect the subdivision to the south, Colorado <br />Technological Center (CTC) Iriling II, with Cherry Street. <br />The subject property was annexed and zoned as part of the Mizel Annexation <br />(CTC) in 1976 but was not subsequently platted. The parcel is located adjacent <br />to and south of Cherry Street, to the south is a five acre parcel zoned Agriculture <br />which is occupied by a home owned by Mr. Bennett. To the west is a 9-acre <br />CTC parcel, under the ownership of The Etkin Johnson Group, where a 130,000 <br />square foot flex building is currently under construction at 1775 Cherry Street. <br />To the east is a regional detention facility owned by the City of Louisville. <br />The subdivision plat and the IPUD proposal are generally in compliance with the <br />requirements of the Louisville: Municipal Code (LMC) with respect to the <br />requirements for subdivision, as well standards of the IDDSG. The final <br />subdivision plat reflects a two lot subdivision. Lot One (4.84 acres) is associated <br />with a final PUD development plan which proposes a phased flex building. Lot <br />Two (1.20 acres) would be developed for a water quality storm detention facility. <br />The parcel is required to dediicate 12% of the land area or pay acash-in-lieu <br />payment equivalent to 12% of the appraised value of the land at the time of <br />subdivision. Staff recommended acash-in-lieu payment as the Department of <br />Land Management is not supporting a land dedication. Staff recommended the <br />applicant pay acash-in-lieu payment based upon the appraised value of the land <br />prior to the issuance of a building permit. <br />The Planning Commission hE;ld a public hearing on July 12, 2007 and forwarded <br />a resolution of support with the following conditions to the City Council: <br />1. The applicant shall execute a Subdivision Agreement to ensure the <br />development of required public improvements. <br />2. The applicant shall mE;et the required public use dedication by the <br />payment of a cash-in-Ilieu payment equivalent to 12% of the appraised <br />value of the land at the time of subdivision. Such payment shall be made <br />prior to the issuance of a building permit. <br />3. The applicant shall provide either a fence or hedge on top of any retaining <br />wall over 30" in height for public safety purposes. <br />Mayor Sisk requested an Applicant presentation. <br />
