City Council <br />Meeting Minutes <br />August 7, 2007 <br />Page 6 of 14 <br />property owners within the Revitalization Area as well as future investors a higher <br />degree of certainty as to the limitations of development on existing zoned <br />parcels, as well as the requirE;ments and timing of a land use entitlement <br />process. 4) Provides a high IE:vel of confidence to the City in its discussions with <br />the RTD related to FasTracks and the current Environmental Assessment (EA) <br />review project. 5) Provides the control necessary to ensure the proposed density <br />is consistent with the adoptecl 2005 Comprehensive Plan. <br />The following design topics are addressed within the Mixed Use Development <br />Design Standards and Guidelines: Street and Block Design Standards; Off <br />Street Parking; Residential Transition; Architectural and Building Design and <br />Energy Conservation and GrE:en Building. <br />The Planning Commission conducted a series of public hearings on the Mixed <br />Use Zoning and Design Standards and Guidelines between April 26, 2007 and <br />July 12, 2007. At the July 12, 2007 public hearing, the Planning Commission <br />approved a motion to forward) a recommendation of support to the City Council. <br />Staff recommended Council continue the public hearing on Ordinance No. 1524, <br />Series 2007, to September 4„ 2007. <br />COUNCIL QUESTIONS <br />Mayor Sisk requested the Council begin by discussing the zoning issues in the <br />Highway 42 Revitalization Plan. <br />Council member Muckle questioned the parks within the plan and asked if the <br />Plan contemplates the City purchasing park land. Planning Director Wood <br />explained one of the parks is Miner's Field, and noted the plan does not <br />contemplate the City purchasing park land. <br />Council member Muckle also had questions relative to the minimum building <br />height, and the limitations on Industrial use. He referred to the Design and <br />Operation Standards and asN;ed who the "Director" would be. Planning Director <br />Wood stated the multiple stories is intended for mixed use, however the CC <br />zoning minimum building height is 45 feet and would not require a minimum <br />building height designation. IHe stated the Planning Director is the "Director". <br />Council member Muckle askE:d if the City could seek voluntarily rezoning and <br />grandfather uses. Planning Director Wood explained property owners would be <br />at a disadvantage should their properties suffer casualty damage, they would not <br />be able to rebuild their businE:ss if it was a nonconforming use. <br />Council Member Muckle discussed the location of the planned rail station and <br />expressed his desire to see that location moved further south. <br />
