City of Louisville Zoning Variance Request Criteria for Zabel Residence <br />Lot 6, Block 4, Centennial Valley Subdivision, Filing #3 - 494 Lois Drive, Louisville, CO <br />1. That there are unique physical circumstances or conditions such as irregularity, narrowness or <br />shallowness of lot, or exception topographical or other physical conditions peculiar to the affected <br />property; <br />a. The ILC indicates the lot is 6489 SF (Boulder County Assessor records indicate <br />6747 SF). However, the lot zoning classification is `Residential Estate' (12,000 SF min.) and <br />therefore, the zoning is not in alignment between approved plot from 1984 and current <br />zoning code. <br />2. That the unusual circumstances or conditions do not exist throughout the neighborhood or <br />district in which the property is located; <br />a. Unlike other lots in this neighborhood, this lot is contiguous to 2 acre City Park — with only 1 <br />private property lot adjoining to the West. <br />b. Little or no impact to adjacent neighbor — addition is single story and within all applicable <br />setback requirements. <br />3. That because of such physical circumstances or conditions, the property cannot reasonably be <br />developed in conformity with the provision of this title (Louisville zoning code); <br />a. The ILC indicates the lot is 6489 SF, however the lot zoning classification is 'Residential <br />Estate' (12,000 SF min.) and therefore lot size & zoning designation are not in alignment. <br />b. Existing house/garage lot coverage is 1437 SF or 22.3% of the lot. <br />c. The proposed addition increases lot coverage to 2134.8sq. ft. (includes covered front porch <br />and covered rear patio) or 32.9% of the lot. <br />d. The size and dimension of this lot is much more consistent with the RM zoning category, <br />requiring a 7000 SF lot size with a minimum lot width of 60' and allowed coverage of 35%. <br />e. The location of the lot, with the park adjacencies, makes this a unique condition in the <br />neighborhood — not duplicated by any other lot in the filing. (see photos) <br />4. That such unnecessary hardship has not been created by the applicant; <br />a. The property was developed and house built approximately 1983-84; purchased by current <br />owner in 2003, Current owner has made no exterior changes other than reroofing and <br />repainting the house. <br />
