Authority Report 2012 (cont.)
Suspected liquor code violations continue to be reviewed on an individual basis by the
Authority as incidents occur. Several incidents were reviewed and determined to require
no further action by the Authority. The Authority continues to encourage license holders
to appear before the Authority to discuss questions and concerns either the licensee or
the Authority might have and what can be done to avoid problems.
The Authority ordered two Show Cause hearings this year:
1. Tri-City Elks Lodge – The incident alleged service to a visibly intoxicated person
and violation concerning conduct of the establishment. A special prosecutor, Mary
Lynn Benham, was appointed, investigated the alleged violations, and reached a
stipulation and agreement with the establishment for a total 3 day suspension with 1
day served and 2 days held in abeyance for a period of one year.
2. Ralphie’s - The incident addressed a possible violation by serving to a visibly
intoxicated person and conduct of the establishment. Kristin Brown was appointed
as Special Prosecutor and after investigation, presented stipulations on the cases.
The licensee admitted to serving to a visibly intoxicated person and the charges
concerning conduct of the establishment were dismissed. They agreed to a total of
a 28 day suspension with 16 days held in abeyance for a service of 12 days total
suspension.
The Authority wishes to extend its gratitude to the Louisville City Council for Council’s
ongoing support of the Authority.
th
Approved by the Louisville Local Licensing Authority this 28 day of January 2013.
Cecilia Wilson
Chairperson
Local Licensing Authority
3
5
