To the extent matters addressed in this chapter are also <br />addressed in state or federal law, it is the intent of the <br />city council that the more restrictive provision shall <br />control. <br /> <br />2.90.040 Request for executive session. <br /> <br />A. A request for an executive session may be made only by the <br />mayor, a councilmember, any attorney representing the city, <br />the municipal judge, the city administrator, the city clerk, <br />or the city treasurer. <br /> <br />B. The request to go into an executive session shall be made in <br />an open session of a public meeting of the city council. The <br />requesting party shall give as detailed and specific a <br />statement as possible, using his or her best judgment to avoid <br />disclosure of any confidential matters, as to the topic or <br />topics to be discussed and the reasons for requesting an <br />executive session. <br /> <br />2.90.050 Public statement. <br /> <br />A. Immediately after a request to go into an executive session, <br />the following statement shall be read by the city clerk in the <br />open public meeting: <br /> <br />"It is the policy of the city to conduct public business <br />in meetings open to the public. While in executive <br />session it is inappropriate to take straw votes, keep <br />minutes, or to make any final decisions. It is the duty <br />of each councilmember to ensure that executive sessions <br />are conducted in strict compliance with this ordinance, <br />state and federal law, and any applicable provisions of <br />the state and federal constitutions. If at any time the <br />scope, nature, or parameter of this executive session <br />goes beyond the publicly stated topic, it is the <br />responsibility of the council to terminate and cease any <br />further deliberation within the executive session and <br />return to the public meeting." <br /> <br />"Only those topics described in city ordinances may be <br />discussed in an executive session. Those topics are <br />summarized as follows: <br /> <br />1. Where federal or state law requires that the <br />information being discussed remain confidential; <br /> <br />2. certain personnel matters involving only employees <br />directly appointed by the council and other <br />personnel matters upon request of the city <br />administrator or mayor. <br /> <br />13 <br />
