Louisville City Council Meeting <br />September 17, 2002 <br />Page 6 <br /> <br />ORDINANCE NO. 1399, SERIES 2002 - AN ORDINANCE APPROVING AND <br />AUTHORIZING AN ALLOTMENT CONTRACT FOR AN ALLOTMENT OF <br />WINDY GAP WATER UNITS - 2nd reading - public hearing (advertised Daily <br />Camera 9/7/02 <br /> <br />Davidson called for City Attomey introduction. <br /> <br />City Attorney Light read Ordinance No. 1399, Series 2002. <br /> <br />Davidson called for Staff presentation. <br /> <br />Public Works Director Tom Phare explained that Ordinance No. 1399, Series 2002 has <br />been requested by the Northern Colorado Water Conservancy Municipal Sub District as <br />part of the City's acquisition of six (6) additional Windy Gap units. The ordinance <br />affirms the City's commitment to be bound by the Northern District's allotment contract, <br />authorizes City Council to proceed with the applicant for said allotment contract and <br />furthermore authorizes the Mayor to execute the allotment contract on behalf of the City. <br /> <br />Phare reviewed modifications to the contract in Section 9, Security, and Section 12, <br />Operation Agreement, and stressed that the Public Works Department will work with the <br />Northern Colorado Water Conservancy District to ensure that the provisions of the <br />contract are met. <br /> <br />Davidson opened the public hearing and asked if anyone in the audience wished to speak <br />for or against Ordinance No. 1399, Series 2001. There were no comments. <br /> <br />COUNCIL COMMENTS <br /> <br />Mayer questioned the provision, which states that the ordinance is irrevocable by the <br />City. He asked City Attorney Light if ordinances could be made irrevocable. <br /> <br />City Attorney Light explained that the contract was entered into by two entities, the <br />Town of Superior and the Town of Estes Park. He stated that the City was not the original <br />participant agreeing to the bond issue, and state statute allow passage of an ordinance that <br />is an irrevocable pledge of revenue until the debt is paid. <br /> <br />Davidson called for public comments. Hearing none, he closed the public hearing. <br /> <br />MOTION: Sisk moved that Council approve Ordinance No. 1399, Series 2002, <br />seconded by Levihn. <br /> <br />Brown emphasized that with the current drought, it is important for the City to obtain the <br />windy gap water units for future purchases of Colorado Big Thompson water rights. <br /> <br />VOTE: Roll call vote was taken.
