<br />~ebruary 11, 1992 <br />staff Report <br />Cl Crk Rch 11, Rplt B <br />Paqe 2 <br /> <br />staff Comments: <br /> <br />At the regular meeting on December 10, 1991, staff requested <br />continuation pending review of both policy and legal issues. <br /> <br />The request was referred to the city Attorney for review of issues <br />regarding the disposition of public lands. The outcome of that <br />review is that the City may proceed with the replat as a method to <br />reduce the area of the City outlots. If authorized, execution of <br />the replat would require deeds of conveyance from the City as well <br />as an ordinance of declaration. <br /> <br />policy issues raised in the course of project referral related to <br />maintenance, access, and restoration issues. The Parks and <br />Recreation Department supports the request as a means to reduce <br />costs and manpower commitmentS'"' for the maintenance of small, <br />limited-use parcels. The Public Works Department is at issue with <br />a reduction of the outlots because of the likelihood of the <br />easement being compromised by private improvements. upgrading or <br />installing new utility lines in a compromised easement raises the <br />need of restor ing pr i va ee improvements ( 1. e. fences and <br />landscaping) regardless of the rights associated with an easement. <br /> <br />staff aecommendation: <br /> <br />To achieve the objectivea of all parties concerned, staff <br />recommends approval of the subdivision replat subject to the <br />following conditions: <br /> <br />1. <br /> <br />Minimum width of Outlot F (between lots 21 and 22) shall be <br />fifteen (15) feet. <br /> <br />t. <br /> <br />2. <br /> <br />Minimum width ot Outlot E (between lots 36 and 37) shall be <br />fifteen (15) feet. <br /> <br />The City shall have limited responsibility for the restoration <br />of private improvements as a result of City maintenance, <br />upgrades, and/or repairs within the designated public utility <br />easements. The City will be responsible for the restoration <br />of grade, ground cover, and irrigation systems only. The City <br />will not be responsible for the restoration of trees, fencing, <br />accessory buildings, and other structures, or shrubs, and any <br />other types of living or nonliving landscape materials. <br /> <br />The maintenance of surface improvements within outlots E and <br />F shall be limited specifically to the pedestrian walk.
