<br />February 11, 1992 <br />staff Report <br />Cl Crk Rch #1, Rplt B <br />Page 3 <br /> <br />prefers that the Coal Creek Home Owners Association be <br />responsible for the maintenance, repair, and upkeep of Outlots <br />E and F, excluding the pedestrian walk. This condition would <br />require a separate agreement. <br /> <br />5. The applicant shall complete all technical revisions prior to <br />review by City Council. <br /> <br />staff is recommending approval for the following reasons: <br /> <br />1. The proposed reduction of the City's fee interest in Outlots <br />E and F, and conveyance of that interest by deed is in <br />compliance with applicable provisions of the Colorado Revised <br />statutes. <br /> <br />2. The proposed replat, if authorized, is consistent with policy <br />directives of both the Parks and Recreation Department and the <br />Department of Public Works. The proposed replat will reduce <br />the cost and manpower commitments associated with City <br />maintenance of the subject property. The proposed replat will <br />not adversely impact the ability of the Public Works <br />Department to perform routine and emergency utility repairs, <br />maintenance, and upgrades within either the easement or <br />outlot. <br /> <br />3. The proposed replat represents an action which will increase <br />the level of landscape amenity overall as well as designating <br />maintenance responsibility specifically to the adjacent <br />property owner or the HOA. <br /> <br />Planning Commission Action: <br /> <br />Resolution 3, Series 1992, declares approval by the Planning <br />Commission and recommends same to City Council. The Commission may <br />also recommend approval with conditions or deny the request. <br />
