<br />identify the terms and conditions on which the District would own and operate the pipeline with <br />Louisville's right-of-way, staff prepared this irrevocable license agreement giving them permission to <br />occupy or cross Louisville's rights-of-way under terms and conditions. The most important being the <br />one that requires them to relocate within Louisville's existing rights-of-way or pay for the City's <br />relocation, if in the future Louisville's utility lines need to be relocated or extended. <br /> <br />Davidson called for Council questions or comments. <br /> <br />Mayer stated that value would be transferred from Louisville to Superior. He felt the City should <br />receive something of value in return. <br /> <br />Sisk agreed with Mayer. <br /> <br />Howard was concerned that the City would be granting Superior license to complete their part of the <br />water project, when they have not to date allowed Louisville to access their land from McCaslin. He <br />did not feel they were acting in good faith. <br /> <br />Lathrop felt there should be some compensation for the granting of this license. <br /> <br />Levihn wanted to know if any other communities involved were getting compensation. <br /> <br />Darrell Zimbelman, NCWCD, P.O. Box 679, Loveland, Colorado, offered to find that information. <br /> <br />Howard wanted to postpone the vote until they were able to answer Levihn's question. <br /> <br />Davidson suggested adding item No. 23 to the agreement stating "As this agreement becomes <br />effective upon the Town of Superior granting reasonable access off McCaslin to land within the city <br />limits of Louisville, south of u.s. Hwy. 36." <br /> <br />Sisk moved that Council approve Ordinance No. 1210, Series 1996, adding a paragraph No. 23 that <br />the agreement would be contingent upon the Town of Superior granting the City of Louisville access <br />to the property located south of U.S. Hwy. 36 and set out for public hearing 2/20/96. Seconded by <br />Howard. Roll call was taken. Motion passed by a 6 - 0 vote with Keany being absent. <br /> <br />Zimbelman updated Council on the progress of the main and connecting pipeline. The first entity that <br />will take delivery of water will be Erie in the next 30 - 60 days. The total payments into the project, <br />including the Department of Energy's $18.4 million, amounted to slightly over $34 million. <br />Louisville's portion was $3.244 million. An additional $145,000 in interest was earned that was <br />credited. Louisville's cost to participate in the Carter Lake to Broomfield line was $3.2 million. They <br />were able to refund to Louisville $263,283. 41. The pipeline from the Carter Lake/Broomfield line <br />down to the pumping plant was completed as of the first part of January. <br /> <br />Davidson congratulated the NCWCD for coming in under budget. <br /> <br />5 <br />
