(a)Pursuant to the Bylaws of the Local Licensing Authority, fingerprint/background investigations are done through the Colorado Bureau of Investigation and the Federal Bureau of Investigation and shall be required for any application which requires a determination of any person’s character or reputation or qualification under the Louisville Municipal Code, the Colorado Retail Marijuana Code, or the regulations promulgated thereunder. The Local Authority shall not be required to perform a criminal background check if the State has performed a check or may, in its sole, discretion perform its own background check. Proper identification, along with proper fees must be presented at the time of fingerprinting/background check for each new applicant, manager, employee and other person required to be qualified. Proper identification means: 1. an identification card issued in accordance with C.R.S. § 42-2-302; 2. a valid state driver’s license; 3. a valid driver’s license containing a picture issued by another state 4. a military identification card; or 5. a valid passport. (b)At such time the application is complete, action on the application may proceed at the request of the applicant if the Authority finds: (1)The fully executed application and each report required as part of the application, indicates that the applicant, partner, manager, officer, stockholder, director of applicant, person holding a financial interest in or lending financial support to the applicant, manager or employee is of good moral character and otherwise qualified pursuant to the Louisville Municipal Code, the Colorado Retail Marijuana Code, and the regulations promulgated thereunder. (2)No other reliable information has been providedto the Authority contrary to that described in paragraph (b)(1) above.
