Mueller stated that they filed for a building permit a few weeks ago and they hope to have a
contractor on site within two weeks.

Sisk wanted all of the front parking to be handicap parking.

Mueller stated that they would lose nine parking spaces if they made the front parking all handicap.

Keany suggested that the nine regular parking spaces be designated as "senior citizen" spaces.

Mueller and Sisk agreed.

Sisk asked why Chili's asked for an alteration in the landscaping guidelines.

Barnhardt stated that the variance was requested in-lieu-ofthe monument sign out front. They felt
that the more than substantial landscaping and density of trees along the perimeter plantings on Dillon
and McCaslin more than makes up for it.

Sisk wanted to make sure that, if the PUD got approved, Lot 2 did not involve a use-by-right of a
gas station.

Keany wanted fencing around the propane tanks at Eagle. He was concerned about the grading
elevation change between the corner of McCaslin and Dillon and the pad for Chili's.

Dan Blankenship, Bucher, Willis, & Ratliff Corporation, 1743 Wazee, Denver, Colorado, disclosed
that he had been employed with the City of Louisville, but while employed here he had no
involvement with this project. He pointed out that the elevation change was 6'.

Mayer was concerned about the amount of room for bicycle traffic. He felt the conceptual PUD's for
Lots 1 and 2 should be dropped. He was assured that there was bike parking at Eagle. He pointed
out that the chain link utility fence at Chili's violated the Gateway Design Guidelines (GDG).

Williams stated they would work with staff and possibly change it to a solid, metal, louvered gate.

Mayer stated that as is required by the GDG, there is no buffer between Firegrill and Chili's. He felt
Chili's should have the requisite number of trees.

Levihn liked the project.

Davidson called for the applicant's summary.

Spriggs, thanked Council for their time and attention to the project. He asked for approval without
conditions No.3 and 4.

10
