<br />Keany moved that Council approve Resolution No. 33, Series 1996, with the following 11 conditions: <br /> <br />1.) Conditions No.1 and 2 stay as is; <br />2.) Condition No.3 is eliminated; <br />3.) Condition No.4 is now condition No.3 and is changed to read "The head-in parking <br />in front of Eagle Hardware store should be posted 'Handicap and Senior Citizen <br />Parking Only'."; <br />4.) Condition No.5 stays as is and becomes condition No.4; <br />5.) Condition No.6 stays as is and becomes condition No.5; <br />6.) Condition No.6 - The chain link fence gates on Chili's will change to a solid material; <br />7.) Condition No. 7 - The rooftop screening on Firegrill will be constructed of a material <br />and color to match the building; <br />8.) Condition No.8 - The exterior ladder on Chili's will be eliminated; <br />9.) Condition NO.9 - Language will be included in the PUD stating that all present and <br />future landowners must be notified in writing that the City may remove the left-in on <br />McCaslin at any time, at its own discretion; <br />10.) Condition No. 10 - The propane tank on Parcel 5 will be screened with a solid wall <br />enclosure; <br />11.) Condition No. 11 - The PUD will eliminate any conceptual proposals for Lots 1 and <br />2. <br /> <br />Howard seconded. <br /> <br />Davidson offered a friendly amendment that the Firegrill be in compliance with the Denver Air Quality <br />Control standards. <br /> <br />Keany accepted that as condition No. 12. Seconder Howard agreed. <br /> <br />Mayer offered a friendly amendment that the landscaping for Chili's, with respect to the trees be <br />brought up to the Gateway Design Standards. Seconded by Sisk. Roll call was taken. Amendment <br />failed by a 3 - 4 vote with Davidson, Howard, Lathrop, and Levihn voting against. <br /> <br />Sisk offered a friendly amendment concerning condition No.9, that it would be placed on the PUD <br />initially, so that would give public notice and any other landowners would then be notified of the <br />condition. <br /> <br />Keany and seconder Howard accepted that. <br /> <br />RECESS <br /> <br />Davidson called for a five minute recess. <br /> <br />Davidson called the meeting back to order. <br /> <br />11 <br />
