<br />Howard stated that was correct. <br /> <br />Roll call was taken. Motion passed by a 7 - 0 vote. <br /> <br />RESOLUTION NO. 40, SERIES 1996 - ACCEPTING A DEDICATION OF OUTLOT X, <br />BELLA VISTA SOUTH SUBDIVISION <br /> <br />Sisk asked to be excused as he represents Mr. Robert Hinsberger. <br /> <br />Davidson excused Sisk. <br /> <br />Paul Wood, Planning Director, stated that this matter came forward when Hinsberger contacted staff <br />with his belief that he had continued to pay property taxes on an outlot associated with the Bella Vista <br />Subdivision. The City Attorney had reviewed this matter and prepared this resolution. The current <br />property owners, Bella Vista Limited Liability, are proceeding under an addendum to the Annexation <br />Agreement to proceed with right-of-way improvements and will be dedicating by deed additional <br />right-of-way. Staff recommended approval of Resolution No. 40 as a means to strengthen the City <br />position to reflect that the dedication was clearly accepted by the City. <br /> <br />Davidson called for Council questions or comments. <br /> <br />Davidson did not know why the City would want this property. <br /> <br />Tom Phare, Public Works Director, stated that the possible arrangements for connecting Bella Vista <br />to 96th Street provided for the extension of Bella Vista. Without the dedication it would force going <br />into a reverse curve, curving towards town, coming in from Centennial Valley, and then curving back. <br />By taking the dedication, it allowed the location of possible connections to be further south of where <br />they would not be, if the City did not have the right-of-way. <br /> <br />Davidson's concern was that Bella Vista is already a busy street for its size and connecting it directly <br />to 96th Street would make it a shortcut to McCaslin from that end of town and the County. He did <br />not see any possibilities of expanding it to more than its existing two lanes. He felt the City would <br />want to construct the connection such that they are encouraging only people that live in that area of <br />town to use it, rather than it becoming a shortcut to get to McCaslin. <br /> <br />(INAUDffiLE) <br /> <br />Davidson wanted to know if Bella Vista currently ran over outlot X and what the connecting road <br />is between 96th Street and this area, south of Bella Vista. <br /> <br />Davidson moved that Council continue Resolution No. 40, Series 1996 to the next Council meeting. <br />Seconded by Howard.
