Planning and Building <br />Safety Director Russ pointed out this simply identified the possibility of the onsite <br />retention being waived if an off-site facility was utilized. It attempts to align policies. <br />Council member Stolzmann asked why call out these 3 areas; why not let them proceed <br />with the PUD process. <br />Mayor Muckle saw these as unique areas but was not opposed to language to clarify <br />that they still have to go through the entire process. <br />Attorney Light suggested adding a phrase at the end of Section 3.3 item (a) "as <br />determined by the City' and at the end of item (b) "if allowed by the City'. The first line <br />on this page to read "specific sub area plans and planned unit development "— leaving <br />out "overall ". <br />MOTION: Council member Lipton moved to approve Resolution No. 29, Series 2014, <br />with suggested changes by the City Attorney, seconded by Mayor Muckle. <br />Council member Stolzmann offered a friendly amendment to remove Section 3.3 <br />completely. Council member Lipton did not accept the friendly amendment. <br />Vote on Council member Lipton's motion: 4 -1 with Council member Stolzmann voting <br />no. <br />ORDINANCE No. 1662, SERIES 2014 — AN ORDINANCE AMENDING CHAPTER <br />3.30 OF THE LOUISVILLE MUNICIPAL CODE CONCERNING AN EMERGENCY <br />TELEPHONE CHARGE — 2nd Reading - Public Hearing <br />Mayor Muckle requested a City Attorney introduction. <br />City Attorney Light introduced Ordinance No.1662, Series 2014. <br />Council member Loo disclosed her husband was on the BRETSA board for fourteen <br />years but was no longer. She reported she would receive no financial benefit other than <br />anyone else and felt her decision could be made without bias. <br />Mayor Muckle opened the public hearing and requested a staff presentation. <br />Police Chief Hayes explained the adoption of Ordinance No. 1662 will put Louisville in <br />compliance with state law. CRS 29 -11- 103(3)(a) which requires cities, counties, towns <br />and special districts to annually establish a 9 -1 -1 surcharge for each calendar year. <br />An ordinance establishing the 9 -1 -1 landline, wireless and Internet (VoIP) surcharge <br />within Louisville for 2014. The current surcharge of 500 per telephone number will be in <br />effect from January 1, 2014 through June 30, 2014 and a new surcharge of 750 per <br />telephone number will be in effect from July 1, 2014 through December 31, 2014.
