CityofLafayettefindsanddeclaresthatthecommunityofinterestintheareasodesignatedon <br />theMapportionofthisPlaniswiththeCityofLouisvilleratherthantheCityofLafayette. <br />(d)County Platted Areas: The Map portion of this Plan identifies areas currently <br />designated as County Platted Areas. Any County Platted Areamay be annexedin accordance with <br />the provisions of the Colorado annexation statutesby a municipality to which the subdivision is <br />adjacent. Nothing in this section or in the Plan is intended to require a municipality to annex such <br />area. <br />(e)AnypropertylocatedwithinthecurrentmunicipallimitsofLouisvilleor <br />Lafayette,andanypropertywhichhereafterannexestoeithermunicipalityinaccordancewith <br />theprovisionsofthisAgreement,whichsubsequentlyisdisconnectedfromthemunicipality, <br />shallthereafter,forpurposesofthisAgreement,beconsideredtobelocatedwithinthat <br />municipality’sinfluencearea. <br />5.OPENSPACE. <br />AnyoftheparcelsdesignatedRuralPreservationAreaonthePlan,labeled as Parcels 2, 5, 6, 7, <br />8, 9, and10on the map attached at Exhibit A,maybeacquiredasopenspacebytheParties.In <br />theeventthePartiesagreethatanysuchparcelshouldbeacquired,BoulderCountyshallpay <br />one-halfofthecostsofsuchacquisition,withLafayetteandLouisvillepayingequalsharesof <br />theremainderoftheacquisitioncost.NothinghereinshallbeconstruedtopreventanyParty,or <br />combinationofParties,fromacquiringanyofthedesignatedparcelsintheabsenceofthe <br />agreementofallParties. <br />6.REFERRALS. <br />Anyapplicationorotherproposalforannexationordevelopmentonanyparcelwithinthat <br />portionofthePlanAreadesignatedRuralPreservationAreashallbeimmediatelyreferredin <br />writingtoallParties,andnoactionshallbetakenthereonbythereferringPartyuntilsuch <br />Partieshavehadtheopportunitytorespondconcerningtheproposal'sconformitytothisPlanand <br />otherlanduseconcerns,allsuchresponsestobereceivedwithin20daysofdateofreferral. <br />7.AMENDMENTS. <br />ThisPlancontainstheentireagreementbetweentheParties.Anyproposedamendmentofthe <br />Planaffectingthejurisdictionoverlandsorthedevelopmentregulationoflandsmustbe <br />referredtothePartiesbytheRegulatoryParty.AmendmentofthePlanshalltakeplaceonly <br />uponapprovalbyresolutionorordinanceadoptedbythegoverningbodyofeachoftheParties, <br />afternoticeandhearingasmayberequiredbylaw.TheRegulatoryPartyshallnotapprovenor <br />permitanydevelopmentorchangeofuseofanyparcelinthePlanAreabyanymeansina <br />mannerinconsistentwiththisAgreementuntilandunlessthePlanhasbeenamendedsothat <br />theproposeddevelopmentoruseofsuchparcelisconsistentwiththePlan. <br />6 <br /> <br />
