and the opportunity to join orintervene shall be permitted to the extent such developmentis in <br />conformance with the rights so acquired and occurswithin the vested period. <br />(ii) Establishment of uses and development in conformance withthe zoning <br />(including approved PUD plans) and other land useand development regulations applicable to the <br />property onthe effective date of this Plan shall be permitted, wheresuch uses or development <br />continue to be permitted under theprovisions of the Boulder County Land Use Code at the timeat <br />which they are sought to be established; Permission forsuch development shall be processed <br />through the normalprocedures otherwise established by Boulder County. <br />(iii)Approval of an NUPUD with residential density no greaterthan 2 units per <br />35 acres by Boulder County upon such landsis permitted pursuant to the regulations generally <br />applicable at the time of application submittal,and such approval is not forpurposes of these <br />regulationsan increase in density. <br />(iv)Any proposed rezoning, subdivision, special use or otherregulatory process, <br />or amendment or modification of any existing zoning, PUD,special or conditional use, or <br />subdivision plat, or issuance of a building permit, orproposed annexation, whether or not coupled <br />with any such regulatory processentered into for any lands designated Rural Preservation Area <br />shall conform to the Plan, or with an approved amendment thereof, in order to be approved by the <br />Regulatory Party. <br />4.ANNEXATIONPROVISIONS. <br />(a)LouisvilleandLafayetteeachagreethattheywillimmediatelydisclosetothe <br />otheranyandallinstancesinwhichtheyareapproachedbylandownersintheRural <br />PreservationAreaseekingannexation.Further,LouisvilleandLafayettebothcommitthatthey <br />arenotcurrentlypursuinganyannexationswithintheRuralPreservationArea. <br />(b)LafayetteInfluenceArea:TheMapportionofthisPlanidentifiesareascurrently <br />locatedwithinunincorporatedBoulderCountywhichmayinthefuturebeannexedtotheCity <br />ofLafayette.NothinginthissectionorthePlanisintendedtorequiretheCityofLafayetteto <br />annexsucharea.However,theCityofLafayetteandtheCityofLouisvilleagreethat,ifsuch <br />areaistobeannexedtooristobeprovidedwaterorsewerservicebyeithermunicipalityin <br />thefuture,suchareawillbeannexedtoandwillbesoservedbytheCityofLafayette,notby <br />theCityofLouisville.ByauthorizingtheexecutionofthisAgreement,theCityCouncilof <br />Louisvillefindsanddeclaresthatthecommunityofinterestintheareasodesignatedonthe <br />MapportionofthisPlaniswiththeCityofLafayetteratherthantheCityofLouisville. <br />(c)LouisvilleInfluenceArea:TheMapportionofthisPlanidentifiesareascurrently <br />locatedwithinunincorporatedBoulderCountywhichmayinthefuturebeannexedtotheCity <br />ofLouisville.NothinginthissectionorthePlanisintendedtorequiretheCityofLouisvilleto <br />annexsucharea.However,theCityofLouisvilleandtheCityofLafayetteagreethat,ifsuch <br />areaistobeannexedtooristobeprovidedwaterorsewerservicebyeithermunicipalityin <br />thefuture,suchareawillbeannexedtoandwillbesoservedbytheCityofLouisville,notby <br />theCityofLafayette.ByauthorizingtheexecutionofthisAgreement,theCityCouncilofthe <br />5 <br /> <br />
