Lathrop asked to be excused as he had several conversations with Mr. Kreutzman about an interest
in one or more of the lots that he owns.

Davidson excused Lathrop.

Paul Wood, Planning Director, combined his comments on Ordinances No. 1222, 1233, and
Resolution No. 48, Series 1996. He stated that the ordinances are dealing with annexation and
zoning of the .66 acre parcel located st the west end of Johnson Street, formally belonging to Mr.
Zukaitis. On Ordinance No. 1222, the water resource fee will be picked up as part of the Annexation
Agreement, approximately $1,290/acre. Ordinance No. 1233 reflected zoning of SF-LD. Resolution
No. 48 addressed the final Subdivision Plat and PUD for an area including both the annexation parcel
and the Kranker property, with a combined total of2.07 acres. This property is split-zoned and if
authorized, it would be zoned RL and SF-LD. At this time, the applicant intended to build two ranch
style homes. The required park dedication fee would be $27,450, picked up as part of the
Subdivision Agreement. He stated that a second condition should be added to the resolution that the
caliper of the street trees be increased to 2".

Davidson called for the applicant's presentation.

Dave Kreutzman, Kreutzman Construction, 4800 Baseline, D-203, Boulder, CO 80303, stated that
they will increase fire safety by adding a hydrant, increase ease of emergency access, install street
lighting, curb and gutter, sidewalks, and upgrade the water and sewer services. He reviewed the
project.

Davidson opened the public hearing and called for anyone wishing to speak on Ordinance No. 1222.

Scott Kranker, 700 Johnson Street, Louisville, Colorado, was in favor of the project.

Davidson called for anyone else wishing to speak.

NONE

Davidson closed the public hearing and called for Council comments or motions.

Bill Simmons, City Administrator, pointed out, in relation to the City's effort to be included in the
Northern Colorado Water Conservancy District, that they will ask the applicant or annexor to agree
to be included in the NCWCD and the fee be paid to the City upon completion of the annexation
documents.

Mayer moved that Council adopt Ordinance No. 1222, Series 1996, on second and final reading.
Seconded by Sisk. Roll call was taken. Motion passed by a 5 - 0 vote with Lathrop being excused
and Howard being absent.

5
