<br />Commissioner Kalish also likes the development plan. Kalish is also concerned with the removal <br />of 22 trees along the ditch and how the existing trees will continue to live with their water source <br />taken away from them by the piping. The ditch is her primary hang-up. <br /> <br />Commissioner Pritchard is also concerned with the loss of the trees. At this time he is leaning <br />toward the City taking the cash-in-lieu because of the tree removal. He feels this is a top-notch <br />project. <br /> <br />Commissioner McAvinew feels that if it was good enough in 1994 it is still good. McAvinew is in <br />favor of the pipe and stated that there is plenty of water there because the ditch does leak. He <br />likes the idea of it being piped and the whole area improved. <br /> <br />Paul Wood added a condition that the shared parking and access agreement between Christopher <br />Plaza I and Christopher Plaza II shall be recorded prior to or concurrent with recording of the <br />Final Plat and Final PUD subject to Staff review and approval. <br /> <br />Motion made by Patricia Thompson to approve Resolution No. 4, Series 2000, a resolution <br />approving a Final Subdivision Plat and PUD Phase I, as written with the amendments made by <br />Paul Wood. Final PUD <br />Development Plan and Final Subdivision Replat to construct 3 speculative <br />industrial buildings on 3 lots totaling 5 acres. <br /> <br />Staff Public Notice Certification: <br /> <br />Ken Johnstone, Principal Planner, certified that public notice was published a second time for this <br />hearing in the Daily Camera on Sunday, December 26, 1999, and mailed and posted on Thursday, <br />December 23, 1999. Staff requested a continuance from the January 11, 2000, Planning <br />Commission meeting. All Planning Commissioners verified that they were familiar with or had <br />visited the site. <br /> <br />Staff Report of Facts and Issues: <br /> <br />Mr. Johnstone stated that there are many unresolved issues on this project at this point. At this <br />time the Staff is optimistic that most if not all of these issues could be resolved. Staff feels that <br />the number of issues is excessive for the Planning Commission to have to consider during a public <br />hearing process. Staff would be pleased to continue to work with the applicant to resolve these if <br />they should wish to request a continuance.
