Lipton read the above resolution and ordinance and requested public notice certification.

Staff Public Notice Certification:
Johnstone reported this was continued from the December 12 meeting therefore new notification
was not required.

Lipton requested staff report.

Staff Report of Facts and Issues:
Johnstone reported the public hearing was continued to January 9, 2001 to allow time for staff to
provide additional information pertaining to potential limitations on logo character heights.
Johnstone indicated they had researched other jurisdiction requirements on logo sizes. He stated
that staff found it to be extremely rare for City sign codes to place absolute limits on character
heights. Only one community (Boulder) limits letter heights in some commercial districts to a
maximum of 24 inches for a single line of text and 32 inches total for two lines of text. Boulder
also places a maximum height of 32 inches for any ‘graphic symbol’, which presumably is
intended to limit logo heights.

Staff is recommending that the limitations on logo height be the same as that for letter height.
Johnstone stated that staff believes the City’s PUD process affords applicants the appropriate
means of requesting and justifying a need for a logo height that is taller than 24 inches and
perhaps taller than the letter height being requested. We are recommending that ‘character’ be
defined as follows: “A character includes any graphic symbol used for sign text, including but not
limited to letters, numbers and logos, provided that any character used for sign text must be a part
of the registered name or trademark of the company or business.” That would limit both letters
and logos to a maximum of 24 inches, except when exceptions might be requested and granted
through the PUD review process.

Lipton requested questions for staff.

Questions for Staff:
Leh suggested a wording change for condition 2. Strike the word registered and insert the words
service mark.

Lipton requested that the wording be reviewed with City counsel.

Lipton requested comments from the public.

Members of the Public:
Hearing no comments Lipton requested staff summary.

Staff Summary:
Johnstone stated that staff is recommending approval of the Ordinance, with conditions that

10
