<br />Public Notice Certification: <br />McAvinew asked staff for public notice certification. <br /> <br />Wood stated that the notice was published in the Daily Camera on October 26, 2003 and was <br />mailed to adjacent property owners and posted in City Hall on October 24, 2003. <br /> <br />Conflict of Interest and Disclosure: <br />McAvinew asked Commissioner if they had any conflict of interest or disclosures. <br /> <br />None heard. <br /> <br />Staff Report of Facts and Issues: <br />McAvinew requested a staff report. <br /> <br />Wood explained that Kenneth Johnstone, the case manager, was unable to attend the meeting and <br />that he would be presenting the facts and issues. <br /> <br />He continued by explaining that the case before the commission is a preliminary subdivision plat <br />for Spruce Street Apartment Subdivision with a request to plat 3 residential development lots <br />ranging in size from 7,000 SF to 14,000 SF, with an RM (Residential Medium Density) zoning as <br />well as the Old Town Overlay Zoning. The total property area is approximately 26,860 SF (0.62 <br />acres). The subject property is located on the south side of Spruce Street, between Highway 42 <br />and the BNSF railroad tracks. The property includes two parcels. The original parcel, which <br />constitutes the northern portion of the property, was shown as Outlot 3 on the original East <br />Louisville subdivision plat, recorded in 1906. The second parcel was added in 1988. It is a <br />portion of an abandoned railroad right of way, which was adjacent to the south property line of <br />Outlot 3. <br /> <br />Wood stated that the first parcel (Outlot 3) is adjacent to Spruce Street and contains two multi- <br />family structures: one duplex and one four-plex. Those structures were built in 1995 and 1970 <br />respectively. <br /> <br />Wood informed the Commission that the property owner, Mr. Paul Hu, has owned the property <br />since the 1970s. He acquired the additional railroad parcel in the late 1980s. He has submitted a <br />preliminary subdivision plat application for a 3-lot subdivision: one lot under each of the existing <br />structures and a third lot which would be vacant and eligible for the construction of one or two <br />units. <br /> <br />Wood continued with an explanation of the survey of the property that had been conducted by <br />Mr. Lee Stadele of Flagstaff Surveying. He pointed out that the Improvement Survey Plat (ISP) <br />that was provided does not appear to identify any significant property line disputes and that the <br />property lines and corners appear to be fairly well established. He did detail two other points: <br /> <br />A.A previous survey completed by the Hascall Company for property located to the <br />south of the subject property does locate the common property line approximately 3 <br />feet further north, into Mr. Hu’s parcels. <br /> <br />3 <br /> <br />
