<br /> <br />B.At the southeast corner of the subject property, an area of 1,232 SF is excluded from <br />Mr. Hu’s parcel. The railroad company previously owned the parcel and Mr. Hu <br />believes that he has ownership to that property. He may be able to make legal claim <br />and pursue a Quiet Title. That process could take several months. <br /> <br />Wood provided information on the yard and bulk requirements for the property, which included <br />the following points: <br />The property is subject to the Old Town Overlay and RM zoning regulations. <br /> <br /> <br />Minimum lot size is 7,000 SF and minimum lot area per dwelling unit is 3,500 SF. <br /> <br /> <br />Lot 1 needs to be 14,000 SF, which is large enough. <br /> <br /> <br />Lot 2 needs to be 7,000 SF, which is large enough. <br /> <br /> <br />rd <br />Remaining area would be used to create a 3 lot, which would be large to support <br /> <br /> <br />either one or two units, depending on the status of the land discussed in the survey. <br /> No specific development is being proposed at this time. <br />Two off-street parking spaces will be required for each unit. <br /> <br /> <br /> <br />Wood then discussed the Public Dedications requirements for the property. Since the majority of <br />the property was platted in 1906 the property is not subject to any additional public use dedication <br />requirements. The railroad right-of-way and the small area that might require the Quiet Title <br />could be subject to the City’s subdivision dedication requirements. Given the small size, <br />approximately 1,500 SF of dedication, a park dedication is not likely, which might suggest a fee- <br />in-lieu should be pursued in conjunction with the final subdivision plat review. <br /> <br />Wood continued with a brief discussion of the right-of-way along adjacent to Courtesy Road or <br />State Highway 42 stating that additional right-of-way may be needed to accommodate road <br />expansions. The ISP has been forwarded to CDOT for comment and will be reviewed again <br />during the final plat review process. <br /> <br />Wood stated that staff is recommending approval of the preliminary subdivision plat for the <br />Spruce Street Apartments Subdivision, with four conditions to be addressed in the final plat <br />submittal. <br /> <br />Commission Questions: <br />McAvinew requested if any Commissioners had questions of staff. None heard. <br /> <br />Applicant Presentation: <br />McAvinew requested the applicant presentation. <br /> <br />Paul Hu, property owner of 1190 – 1210 E. Spruce Street, informed the Commission that he has <br />contacted the Boulder County Assessor regarding the Quiet Title and will be contacting an <br />attorney to move forward with the process. He stated that he would answer any questions they <br />have. <br /> <br />Commission Questions: <br />McAvinew requested if any Commissioners had questions of Mr. Hu. <br /> <br />4 <br /> <br />
