The <br />recording of such easement shall be a prerequisite to the recording of any such replat or <br />PUD plan. <br /> <br />3.The Owner shall execute a covenant which holds both lots as one. The covenant will <br />remain in place as long as the existing residence encroaches on proposed Lot 2. <br /> <br />Commission Questions of Staff: <br />Deborski requested clarification of the demolition of the residence and the timing for the <br />building the new home on the new lot, Replat Lot 2. <br />Wood explained that the demolition would be completed prior to any issuance a building permit <br />for the new residence. <br /> <br />Lipton asked how many square feet are in the current home. <br />Wood replied, approximately 11,000 SF. <br /> <br />Kalish requested clarification of the request for the relief from the RR zoning. <br />Wood explained that the relief is for the ratio of the lot width to the lot depth. <br /> <br />McDermott asked if the 1.5 acre easement was buildable land. <br />Wood explained that the easement would not permit any new building within the easement. <br /> <br />McDermott expressed concern with the location of the Davidson Ditch and its relationship to the <br />easement and the access to the ditch. <br />Wood explained that the ditch is to the west of Lot 1. <br /> <br />Loo requested clarification on the following: <br />The conservation easement to make sure that it was irrevocable and could not be sold and <br /> <br /> <br />the intent is to keep the area as open land. <br />The landscape materials that could be grown in the easement were not for commercial or <br /> <br /> <br />nursery stock. <br />The annexation agreement limits the number of residents to the two homes. <br /> <br /> <br />Wood confirmed she was correct on all three points. <br /> <br />Kalish discussed the conservation easement with staff and asked if the City was will be accepting <br />responsibility for the enforcement of the terms of the conservation easement. <br />Wood confirmed that the City would be responsible for the enforcement. <br /> <br />Kalish requested that staff clarify of the right-of-way vacation and if possible to use one of the <br />exhibits included in the meeting packet information. <br />Wood referenced Exhibit B during the explanation of the vacation. <br /> <br />Kalish expressed concern with the size of the proposed lots and their relationship to adjacent lots. <br />3 <br /> <br /> <br />
