Cityof- <br />Louisville <br />COLORADO -SINCE 1878 <br />LEGAL COMMITTEE <br />AGENDA ITEM 7 <br />SUBJECT: <br />ZONING AND VESTED LAND USE RIGHTS IN THE SMALL <br />AREA PLANS (SOUTH BOULDER ROAD AND MCCASLIN <br />CORRIDOR) <br />DATE: SEPTEMBER 18, 2014 <br />PRESENTED BY: PLANNING DEPARTMENT <br />SUMMARY: <br />At the August 20 meeting Committee members asked for more information regarding <br />what changes and entitlements are currently allowed in the two small area plan <br />corridors. Attached is the "Stability and Change" portion of the 2013 Comprehensive <br />Plan. This information illustrates the remaining allowed development in these areas. <br />However, this is not detailed information by parcel or ownership. As a part of the 2013 <br />Comprehensive Plan, staff conducted a City -wide assessment of the potential build -out <br />of the entire City with current zoning allowances. This analysis was crude and did not <br />differentiate by use group, nor by design allowances within established design <br />guidelines. Staff will conduct a more detailed "yield" study as part of the South Boulder <br />Road and McCaslin Small Area Plans. <br />Also attached is a copy of General Development Plan (GDP) for the McCaslin Corridor. <br />Staff included this to illustrate that while every area in town is zoned, there are then <br />other layers on top of zoning that affect build out and vested rights. In the McCaslin <br />Corridor most every parcel is zoned Planned Community Zone District (PCZD) but on <br />top of that there are then development agreements and GDPs, each of which also <br />governs the uses of the land within the PCZD area. <br />Staff will be available to answer any questions about these zoning rights and processes <br />at the meeting. <br />FISCAL IMPACT: <br />None. <br />RECOMMENDATION: <br />Discussion <br />ATTACHMENT(S): <br />1.
