No Public Land Dedication (PLD) required. <br />• Single 14,436 SF lot subdivide into two separate lots in the residential low (RL) zone <br />district. <br />• Current address is 517 Lincoln Avenue, northwest corner of Lincoln Avenue and <br />Hutchinson. Bounded on west side by Louisville Elementary School and located in <br />Residential Low (RL) District and Old Town Overlay. <br />• 14,436 SF lot which comprises five 25' x 120' Tots, a standard in Old Town. <br />• Existing 2,301 SF house with 882 SF detached garage. Both structures would be <br />retained. House would be located on Lot 1 and the garage located on Lot 2. <br />• Request taken to Board of Adjustment (BOA) and received approval for Lot Width, Lot <br />Area and Rear Setback Variance. <br />• BOA approval does not guarantee approval of replat. Applicant is appearing before <br />Planning Commission and City Council to receive plat. <br />• Lot 1 measures 6,870 SF. Lot 2 measures 7,392 SF. Applicant wants to separate <br />property into two separate lots to make it more compatible with neighborhood. <br />• Staff analyzed the immediate neighborhood from Pine to Hutchinson, counting all <br />properties, 24 total. The average lot size is 6,804 SF. Lots being requested currently <br />are comparable to the average lot size. <br />• The new lots would comply with the neighborhood and this application does comply with <br />the minor subdivision criteria as established Section 16, and does comply with 2013 <br />Comprehensive Plan for this area. <br />Staff Recommendations: <br />Staff recommends Planning Commission approve Resolution No.16, Series 2014, a resolution <br />recommending approval of a replat to subdivide a single 14,436 SF lot into two separate lots in <br />the Residential Low (RL) zone district, located at 517 Lincoln Avenue, Lots 13,14,15,16, and 17, <br />Block 5, Acme Place Subdivision, with no conditions. <br />Commission Questions of Staff: <br />Tengler asks about setback for garage. If owners sell property, will setback still apply? <br />McCartney says it carries with the property. This is the intent that someone could come forward <br />from the garage, and have the ability to connect. <br />Rice asks about the BOA and the variances. Planning Commission is being asked to approve <br />the property being divided into two lots. <br />McCartney says yes. <br />Russell asks about the waiver on the setback and it going with the building or the lot itself. <br />McCartney says it goes with the lot. <br />Tengler asks the 10' setback. If there was no existing building, would Staff have recommended <br />differently? <br />Staff recommended denial. It was overturned by BOA and reasoning was that the existing <br />structure is a 20' tall building, which is smaller than what is allowed at 27' tall, and can be added <br />
