Planning Commission <br />Meeting Minutes <br />September 11, 2014 <br />Page 6 of 9 <br />Summary and request by Staff and Applicant: <br />Brauneis asks if proactively, these properties can be platted? <br />McCartney says Staff can research with the City Attorney about platting these properties. <br />Russell asks about the purpose of the PLD or cash in lieu and why it is applied. <br />McCartney says because of impact on public, the public benefit has to be for parks, schools, or <br />roads. Because a development will impact the public, the applicant must "pay your way ". <br />O'Connell asks about the potential condition requiring the applicant to do a quit claim deed for <br />access to utilities. <br />McCartney says Staff is okay with it. <br />Staff recommends Planning Commission approve Resolution No.15, Series 2014. If the <br />Planning Commission believes a public land dedication is required, staff recommends the <br />following condition be added: <br />1. The applicant shall have an appraisal performed allowira e City Manager, or designated <br />staff, to establish the 15% cash in lieu fee. <br />Closed Public Hearing and discussion by Commission: <br />O'Connell is in favor of waiving any fee in lieu or PLD. She wants to see a condition regarding <br />the quit claim deed so a precedent can be set for future lots. <br />Russell is in favor. <br />Rice is in favor. <br />Tengler is in favor. <br />Brauneis is in favor and agrees with the condition for the quit claim. <br />Pritchard is in favor. <br />Motion made by O'Connell to approve Resolution No.15, Series 2014, recommending approval <br />of final Plat to legally plat an existing parcel located south of Elm Street and legally described as <br />Lots 13, 14, and 15, Parbois Addition Subdivision, located at 536 Main Street, with the condition <br />that applicant quit claim the necessary land to City of Louisville as previously discussed and <br />agreed upon, seconded by Russell.
