Evidence of this annexation is also found on the Cedarwood Park <br />annexation, which is west of this requested development. The Cedarwood Park <br />annexation map shows this area within the Louisville City Limits. Cedarwood Park was <br />annexed in 1979. <br />Although the property appears to have been annexed, there is no evidence the property <br />was ever platted. Section 16.04.040 of the Louisville Municipal Code (LMC) establishes <br />the need for a plat prior to construction, "whoever divides or participates in the division of <br />a lot, tract, or parcel of land into two or more lots, sites or other divisions of land for the <br />purposed whether immediate or future, of sale or building development, whether <br />residential, industrial, office, business or other use, who desires to build a structure upon <br />any tract of land which has not been previously platted, shall make the transaction <br />subject to the provisions of this title and a plat therefor must be submitted to and <br />accepted by the city according to the terms set forth in this title. The terms of this title <br />shall also include and refer to any division of land previously subdivided or platted." <br />Public Land Dedication - LMC Section 16.16.060 <br />LMC Section 16.16.060 establishes the requirements for a public land dedication for all <br />new plats. 15% of the land platted, or an equivalent fee in lieu, must be dedicated for <br />public purposes for all residentially platted subdivisions. <br />The unimproved lot has an appraised value of $224,000. The 15% public land <br />dedication would require a land dedication of 8,315 SF, or $33,600 cash in lieu. The <br />proposed development provides a total land dedication of 5,918 SF, or 10.7% in the form <br />of a linear park intended to serve two purposes: 1) A celebration of the Historic ACME <br />Mine; and, 2) a trail designed to improve access to Louisville Elementary School.
