Since there was a structure <br />since 1908, owner has paid taxes for almost 100 years. <br />Staff Recommendations: <br />Staff recommends Planning Commission approve Resolution No.15, Series 2014. If the <br />Planning Commission believes a public land dedication is required, staff recommends the <br />following condition be added: <br />1. The applicant shall have an appraisal performed allowing the City Manager, or designated <br />staff, to establish the 15% cash in lieu fee. <br />Commission Questions of Staff: <br />Pritchard states there are two items pertaining to 536 Main Street: email and City of Louisville <br />historical record of property, residential history, and historic items donation. Motion made by <br />Brauneis to submit items for record, seconded by Tengler, passed by voice vote. <br />Brauneis asks about other lots that need to be platted. <br />McCartney says there are approximately ten lots. <br />Rice asks about the procedure and does it need to be done incrementally lot by lot. <br />McCartney says affirmative. Code states that prior to any development, applicant must go <br />through processes established in Chapter 16. <br />Rice asks about PLD requirement. This project requires either land dedication, cash in lieu, or <br />waiver. Does Planning Commission have power to waive the PLD? <br />McCartney says affirmative and City Council makes final determination. <br />Rice asks about email's concern regarding density. Can this property become a multi - family <br />situation? <br />McCartney says lot is virtually vacant and zoned RM. Current zoning is one unit per 3500 SF, so <br />owner can propose a three -unit development. <br />Russell asks about cash in lieu and Staff supporting waiver. <br />Sean says that because owner has been payin for utilities and has paid taxes, PLD can be <br />waived. <br />Applicant Presentation. <br />Representative and Applic trier Steg evil Arts, Inc., 1500 Kansas Street, Suite 2E, <br />Longmont, CO, 80501 presents from Power Point. <br />• The Romano family has resided in Louisville since the town began. <br />• Mr. Steger was hired by the City of Louisville several years ago create a report by Public <br />Works Department regarding viability of the City to have title to streets and alleys in an <br />unrecorded subdivision. Mr. Steger informed Louisville that it needed to get title to roads <br />and all ' s. As part of this process, Public Works has requested, and the applicant will <br />offer, a . claim deed to the alley behind and the road in front. <br />Commission Questions of Applicant: <br />None. <br />Public Comment: <br />DAJ Architects (Andy Johnson), 922 -A Main Street, Louisville, CO. Mr. Johnson resides in <br />Louisville and knows the property personally and professionally. He remembers a similar <br />property on Johnson that was an island in Louisville, non - platted and un- annexed property. The <br />property had been contributing to the City for 100 years. The Planning Commission and City <br />Council decided to waive the PLD. He believes that as a resident, business owner, and <br />professional working in Louisville, this property (536 Main Street) has been a contributing <br />property with a water tap and sewer utilities that have been paid. He encourages the Planning <br />Commission to waive the PLD. <br />
