<br />Sisk felt that in instances like these where the City has an expenditure of time and attorney's fees, it <br />is something the developer should have to pay. <br /> <br />Tami Tanoue, Griffiths & Tanoue, stated that perhaps an application fee could be established by <br />ordinance or resolution. For the vacation itself, compensation would not be appropriate. She will <br />be looking into it. <br /> <br />Sisk moved that Council approve Ordinance No. 1233, Series 1996, vacating the storm drainage and <br />utility easement in Louisville North, First Filing, seconded by Keany. Roll call was taken. Motion <br />passed by a 5 - 0 vote with Howard being absent and Levihn arriving late to the meeting. <br /> <br />MARTENS ANNEXATION <br /> <br />RESOLUTION NO. 67, SERIES 1996 - FINDING SUBSTANTIAL COMPLIANCE <br />OF AN ANNEXATION PETITION FILED WITH THE CITY OF LOUISVILLE, <br />COLORADO, KNOWN AS THE MARTENS ANNEXATION, AND SETTING A <br />PUBLIC HEARING THEREON <br /> <br />Paul Wood, Planning Director, in speaking on Resolution No. 67, Ordinance No. 1234, and <br />Ordinance No. 1235, that this is a voluntary annexation of approximately six acres at 1212 South 96th <br />Street, directly north of the Johnson property. The property is occupied by a single family home with <br />the accessory out-buildings. The property is divided into two parcels with the residence located on <br />the front one and one-half acres along South 96th with the balance of the property undeveloped. <br />Planning Commission reviewed the annexation and zoning on October 8 and supported the <br />annexation and zoning of Agricultural. Concerning Ordinance No. 1234, based on August 20 Council <br />comments, staff had incorporated the following provision into the annexation agreement: <br /> <br />1. ) Waiver of the Capital Improvement Fee for the residential unit. This fee would not <br />be assessed for an existing residential structure or the replacement of that structure. <br />2.) Louisville will not require "Owner" to dedicate, transfer, or convey any water rights, <br />nor require "Owner" to pay any fee in lieu thereof, to Louisville as a condition of the <br />annexation of the property. The Owner, at the time of subdivision and/or PUD <br />approval, shall pay a water resource fee for raw water acquisition in accordance with <br />Resolution No. 52, Series 1988, as amended by Resolution No.9, Series 1989. <br /> <br />Wood stated that the applicant requested, in addition, if the property is developed as an <br />indoor/outdoor tennis facility, the open space dedication requirement be waived at the time of platting <br />the property. The applicant also request reimbursement of the $660 annexation fee which was paid <br />at the time the annexation petition was submitted. Ordinance No. 1235 zoned the property <br />Agricultural which the Planning Commission had approved. <br /> <br />3 <br />
