City Council <br />Meeting Minutes <br />November 3, 2014 <br />Page 10 of 18 <br />Council member Keany explained the payment in lieu and the land dedication is 17.1 % <br />of the previous sale value. Even with an updated sales appraisal of $1,050,000, the <br />developer has already met the requirement. <br />Council member Lipton felt as a matter of practice the Council should get a current <br />appraisal whenever property is purchased or when trying to determine an appropriate <br />land dedication. <br />Council member Loo supported the proposal as presented and asked Mayor Muckle if <br />he would propose a condition relative to the mine shaft. Mayor Muckle stated he would <br />request the City Attorney to draft a condition. <br />Council member Loo supported the proposal, but noted the park maintenance will <br />eventually be the City's responsibility and felt it would be expensive to maintain. <br />Council member Stolzmann inquired whether the HOA could be required to maintain the <br />sidewalk and park. Mr. Phillips explained typically in an infill area of 20 homes or more, <br />the HOA may assume this type of maintenance, however with only six homes it would <br />be a burden for the homeowners. <br />Council member Moss inquired about the actual cost to maintain the park. Parks and <br />Recreation Director Stevens noted the Parks Departments has been looking for a <br />partnership to continue the trail connection. He felt the pilot park would be a catalyst to <br />create a historic walk from Hutchinson to South Boulder Road. With respect to the cost <br />to maintain the park, he stated it would not be any more or less than any other park. <br />Council member Moss felt the City should step away from the maintenance and <br />consider this as a requirement of the Home Owners Association. Parks and Recreation <br />Director Stevens stressed the importance of the City's standards of maintenance as <br />opposed to a HOA standard. He recognized there will be a cost. <br />Council member Moss agreed the Council should request another appraisal, so as not <br />to set precedence. <br />Council member Lipton agreed with Parks and Recreation Director Stevens comments. <br />He inquired about the annual maintenance cost. Parks and Recreation Director <br />Stevens estimated less than $1,500 per year. He explained during the two year period <br />the City could determine whether the plant materials are appropriate for low cost <br />maintenance and request changes as deemed necessary. <br />Council member Loo asked if the design and the landscape had already been <br />approved. Parks and Recreation Director Stevens stated there are opportunities to fine <br />tune and modify the plan and to resolve the HFAB's concerns. During the warranty <br />period the City can continue to fine tune the landscape plan. <br />
