City Council <br />Meeting Minutes <br />November 3, 2014 <br />Page 11 of 18 <br />Mayor Pro Tem Dalton supported the proposal and was satisfied with the public land <br />dedication. He suggested a policy discussion on public land dedication at a future date. <br />MOTION: Mayor Muckle moved to approve Resolution No. 68, Series 2014, with the <br />conditions included in the resolution as well as added conditions as outlined by the City <br />Attorney, seconded by Mayor Pro Tem Dalton. <br />City Attorney Light offered a friendly amendment on the revisions to the conditions: <br />1. The applicant shall continue to work with the Historical Commission to ensure the <br />information shown on the interpretive sign is sufficient for interpretive purposes; <br />2. The deed restriction prohibiting the accessory structures from ever being finished <br />shall be expanded to prohibit any second floor construction on detached <br />accessory structures including garages. These restrictions shall be included in <br />the recorded subdivision agreement; <br />3. The applicant shall include a note on the PUD which states" Hutchinson Corner <br />LLC shall pay for an archeological survey and excavation monitoring of the Acme <br />Mine Shaft." This requirement shall be included in the subdivision agreement; <br />4. Prior to City acceptance of the Tract B conveyance and final acceptance of the <br />Tract B improvements subdivider shall at its expense provide additional stamped <br />Geotechnical Report addressing the suitability of the mine shaft mitigation <br />measures. <br />Mayor Muckle and Mayor Pro Tem Dalton accepted the friendly amendment. <br />MOTION: Council member Lipton moved to have the 2013 appraisal updated, seconded <br />by Council member Moss. City Attorney Light offered the following friendly amendment: <br />1. Applicant shall provide an updated appraisal dated after City Council approval <br />for the determination of the cash in lieu amount to be paid pursuant to LMC <br />16.16.060(B)(2). The cash in lieu payment amount shall be specified in the <br />subdivision agreement and be paid at the time of the recording of the plat. <br />Council members Lipton and Moss accepted the friendly amendment. <br />Council member Stolzmann voiced her support of the motion and explained the <br />mitigation to the mine shaft should not be included in the park or the land dedication. <br />Although she did not feel this meets all the land dedication requirements, this proposal <br />has historic value the public will benefit from. She requested the appraisal value not <br />include the mitigation measures. <br />
