City Council <br />Meeting Minutes <br />November 3, 2014 <br />Page 8 of 18 <br />public land dedication language in the Louisville Municipal Code needs to be updated. <br />It was designed for larger subdivisions. <br />Council member Stolzmann felt it was not about an appropriate amount of time for the <br />appraisal, but about a current appraisal, which means something in different economies. <br />She did not agree with putting a fixed period of time on the appraisal. <br />Mayor Muckle also agreed there should be a more current appraisal. He stated the <br />monument for the Acme Mine project is a very important part of the project and for the <br />community, but questioned whether the City wants the liability of owning the land where <br />the mine shaft is located. He felt the project has many merits, but noted there are <br />issues with the appraisal and the liability for the mine shaft. <br />Mr. Phillips stated the request for a walking park was made by the Parks Department, <br />because of the close proximity of Louisville Elementary School. He explained it was a <br />joint effort to build the park instead of the cash in lieu fee. It was designed specifically <br />to the right -of -way, which encompassed the vision to showcase the mine shaft and <br />protect the right -of -way. The City, past and present developer agreed upon the park. <br />Council member Loo commented going forward there can be a discussion on what is <br />considered the best appraisal. She felt the applicant has been in the process for some <br />time and she was comfortable with the current appraisal. With respect to the public land <br />dedication, she would rather have the money instead of the park. She asked if the <br />maintenance of the park could be taken out of the Historic Preservation Fund. Planning <br />and Building Safety Director Russ explained in order to use funds they must be <br />designated by the Historic Preservation Commission and City Council as a landmark or <br />new construction meet character criteria to be eligible for those funds. <br />Council member Loo commented the project is very nice and was happy the applicant is <br />putting fewer homes on the land. She felt it would be a nice addition to the City. <br />Planning and Building Director Russ provided some background on the park. He <br />explained Public Works, Parks and the Planning Division regularly hear parents' <br />concerns about children crossing Pine Street to get to school. He stated this is an <br />opportunity to solidify the southern side of Hutchinson for school access from <br />Community Park to Hutchinson. He felt it would be better to build on the trail system <br />and noted it was not all about the Interpretive Park. <br />Council member Keany inquired about Mayor Muckle's concern over the subsidence at <br />the park area. Mayor Muckle stated his concern centered over whether the shaft has <br />been adequately mitigated before the City takes ownership. <br />Council member Keany asked Planning and Building Safety Director Russ to address <br />the Mayor's concern.
