Louisville City Council Meeting <br />January 7, 2003 <br />Page 4 <br /> <br />RESOLUTION NO. 1, SERIES 2003 - A RESOLUTION APPROVING <br />AMENDMENTS TO CONSERVATION EASEMENTS OVER THE BOWES <br />PARCEL 1 PROPERTY <br /> <br />Davidson called for Staff presentation. <br /> <br />City Attorney Sam Light reviewed the Resolution No. 1, Series 2003, which approves <br />amendments to Conservation Easements over the Bowes Parcel 1 Property. He explained <br />the City of Louisville and Boulder County each own an undivided interest in fee simple <br />title to a 66-acre parcel of land referred to as the Bowes Parcel 1 Property, located at the <br />southeast corner of the intersection of Dillon Road and South 88th Street. The property, <br />acquired in 2002, is subject to reciprocal conservation easements from the City to County <br />and the County to City, recorded on May 4, 2000. <br /> <br />Light explained the City and County entered into an agreement with the Great Outdoors <br />Colorado Trust Fund (GOCO) to receive a grant to assist in funding the City and <br />County's acquisition of the Bowes Property. The $130,640 grant is the remaining money <br />owed to the City and County for the Warembourg property. Since the parcel included a <br />third party conservation easement requiring amendment for GOCO participation, GOCO <br />suggested using the remaining money for a fee simple purchase by the City and County. <br />Thus the City and County desire to amend the Bowes conservation easement to <br />incorporate certain provision which are required by the GOCO Board and which are <br />intended to further preserve for scenic, open space, agricultural, passive recreational and <br />environmental uses, the natural condition and aesthetic and ecological features of the <br />property. <br /> <br />Light reviewed the amendments, which include creation of a baseline inventory and land <br />management plan; creation of certain enforcement rights in GOCO; some additional <br />restrictions on certain activities, such as signage, structures and trails; and provision for <br />GOCO to recoup its share of the purchase price for the property, which is approximately <br />7%. The property includes certain water rights that were jointly acquired and placed <br />under the existing conservation easements. <br /> <br />Light noted that the Resolution authorizes the Mayor to execute the Amendments on <br />behalf of the City and to negotiate and approve revisions to the amendments as the Mayor <br />determines are necessary or desirable for the protection of the City, so long as the <br />essential terms and conditions of the amendments are not altered. <br /> <br />COUNCIL COMMENTS <br /> <br />Sisk voiced his concern over the involvement with GOCO on the Bowes property. His <br />concern centered on a north-south access to Monarch High School from Dillon Road. He <br />suggested taking a portion of the easement for future consideration for an access. <br /> <br />4 <br /> <br /> <br />
