The land owner/developer will improve and maintain this recreational
facility for semi-public use and the City will gain a recreational facility with no responsibility for on-
site improvements or maintenance. They did not have a problem with the 120' right-of-way
dedication or that it is two feet in front of the house. In discussions they had been encouraged to get
rid of the house which is too close to the right-of-way, concerns about expansion of the road, and
they will be billed between $12,000 and $15,000 for a tap fee. They requested the house remain as
it is. If the City requires that the road encroach in the house or the house have to be moved, they
asked that they be fairly compensated. They preferred to have an annexation agreement intact before
they make any final decisions tonight. They requested discussion and to table the final decision.

Mayer was concerned about the parking, which he wanted to be on-site.

Sisk thought cash-in-lieu-ofland dedication was a possibility. He wanted to see this tabled and the
applicants to get together with staff

Davidson moved that Council table Ordinance No. 1234, Series 1996, and continue the public hearing
until February 18, 1997, seconded by Sisk.
