Bendell: No, Sir.

Sisk wanted to see fiber optics as part of the cable television package. He wanted a provision in the
agreement that would provide in advance for fiber optics for Scripps Howard to be installed. He
stated that it would not be in competition with ICG.

Bendell stated that they had no problem with providing it to Scripps Howard for cable television
purposes for the residents of Louisville.

Sisk wanted that in the agreement, stating that it was for cable television purposes which is franchised
by the City of Louisville.

Sisk moved that Council approve the Revocable License Agreement with ICG Access Services, Inc.,
and authorize the Mayor to execute the agreement, amending the agreement to provide that the City
of Louisville would be allowed to utilize for its cable television franchisee, the cable that will be put
in so the city could have fiber optics communication, for the express use of cable television and use
of the city's residents. Seconded by Howard. Roll call was taken. Motion passed by a 7 - 0 vote.

RESOLUTION NO. 73, SERIES 1995 - APPROVING A FINAL SUBDIVISION REPLAT
AND AN AMENDMENT TO A FINAL PUD DEVELOPMENT PLAN FOR THE ASPEN
GREENS SUBDIVISION

Paul Wood, Planning Director, stated that this proposes two office buildings totaling 28,500 s.f. of
gross floor area on Lots 101 and 102, with 118 parking spaces. Staff supported the parking
allocation. Staff did not support the requested signage because of the cumulative visual impact of
existing signs within the subdivision. He pointed out that Outlot A had always been an outlot and
had never been dedicated to the city or had a public function up to this point. Because of the
Goodhue Ditch 3' easement, the applicant was asking to run the pedestrian path down through Outlot
A. Therefore, they were asking the city to accept dedication of the outlot, approximately 7,000 s.f.
It would be an expansion to the existing greenbelt behind there. Because the pedestrian path goes
through there, the Parks Department did not oppose the dedication, but requested that the subdivider
maintain Outlot A. Outlot C would be incorporated into Lots 101 or 102. The applicant requested
a 10' building height variance. This resolution had two conditions of approval (SEE ATTACHED).
He commented, as a third condition, that if Council were to accept the outlot, staff recommended
that the outlot, with the exception of the bike path, be maintained by the subdivider.

Davidson called for the applicant's presentation.

Erik Hartronfi, Hartronft Associates, 1021 South Boulder Road, Suite 1, Louisville, Colorado,
representing Regal Investment Associates, Ltd., stated that Planning Commission had added that they
restrict the medical/dental office to 40% for each building. He asked that it be amended to allow 40%
aggregate for the site, because of the way the leasing was going, one building may have more than
40% and one less or none. He wanted two signs, as allowed by the zoning, instead of the one,

7
