The language in that section was in agreement with the <br />applicant or the subdividers, with the exception that they would like to address Council with one <br />change of language, that the right-of-way be dedicated not as the city requests, but at the point of <br />approval of the Final Subdivision Plat. Section 7 provided two definitions of the term "Extended Stay <br />Hotel." One version provided for the use as a permitted commercial use for rental or lease for a <br />period of less than 30 consecutive days and prohibited conversion to a multi-unit or multi-family <br />dwellings. In the alternative version, the use is not a permitted commercial use. He commented that <br />if this agreement is authorized, it would allow a majority of the retail square footage to be allocated <br />to Parcel L1. He noted that the agreement as drafted would not require a minimum FAR and <br />therefore would not preclude small pad users on Parcel L1. Staffs recommendation was that, if <br />accepted, this agreement not go into effect until all parties have signed off on the Fifth Amendment <br />to the Interchange Agreement. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Don Shonkwiler, H.D. Delaware Properties, 400 South McCaslin, Louisville, Colorado, stated in <br />relation to Section 6, they wanted to follow the practice that had occurred in Centennial Valley to this <br />time, to dedicate and plat roadways as they are platting subdivisions. They wished to do it in <br />conjunction with any subdivision or plat on Parcel L that would come before Council for approval. <br />Concerning Section 7, he wanted clarification as to whether Council did or did not want to allow an <br />"Extended Stay Hotel." <br /> <br />James Shipman, Isaacs & Rosenbaum, Woods & Levy, 633 - 17th Street, Denver, Colorado, <br />representing Property Trust of America, addressed the language proposed for the Development <br />Agreement concerning Section 7, "Extended Stay Hotel." He stated that the "extended stay" concept <br />is a proven market. He explained that the period of the rental would be 30 days or less with regular <br />maid service. Sales tax would be collected. The "30 days" differentiates from a "dwelling unit" that <br />rents for 30 days or more. <br /> <br />Mark Neuman, representing Property Trust of America, 125 Lincoln Avenue, Santa Fe, New Mexico, <br />was there to answer any questions concerning the facility. <br /> <br />Davidson called for Council questions. <br /> <br />Sisk asked about daily rental. <br /> <br />Neuman stated that you can rent them for one day at a time, but they rent them for one week at a <br />time, so one night's stay would be the same charge as one week's stay, $200. He commented that <br />they are the fastest growing hotel chain in the nation right now. There would be laundry facilities for <br />the guests. <br /> <br />Keany asked Shonkwiler how he would change the language in No. 6. <br /> <br /> <br />
