Shonkwiler suggested the wording be changed to "The right-of-way will be dedicated to the city <br />coincident with any subdivision plat approved for Parcel L." He stated that language could be <br />incorporated that would provide for a temporary emergency access across the property. He felt the <br />access should be restricted as an "emergency" access. <br /> <br />Keany asked if Shonkwiler was comfortable with the language in No. 7. <br /> <br />Shonkwiler agreed and added that the language ought to be incorporated in the PUD. <br /> <br />Mayer wanted the language clarified in No. 3 to designate that the more restrictive guidelines apply. <br /> <br />Bill Simmons, City Administrator, stated that the current language in paragraph No. 6 was most <br />beneficial to the city. <br /> <br />Howard felt Shonkrwiler's wording change would tie the city's hands. Concerning No. 7, he thought <br />the Municipal Code should be referenced in the last sentence. He also wanted the "maid service" <br />defined more clearly. He felt the "extended stay" was too loosely worded. He wanted the "kitchen" <br />defined as a "limited kitchenette" and clarified. <br /> <br />Levihn felt the wording in Nos. 6 & 7 should remain as is. <br /> <br />Mayer moved that Council approve the agreement going with 7B, incorporate Shonkwiler's language, <br />"The right-of-way will be dedicated to the city coincident with any subdivision plat approved for <br />Parcel L.", with No. 6. Seconded by Sisk. <br /> <br />Shonkwiler stated that 7B might prevent them from signing the agreement. <br /> <br />Davidson: <br /> <br />For clarification, what this does is change paragraph <br />six to dedication of the road at subdivision. It includes <br />in paragraph seven the language which does not permit <br />extended stay hotels for commercial use. <br /> <br />Susan Griffiths, City Attorney: <br /> <br />I assume along with that would be a provision for <br />emergency access. <br /> <br />Mayer agreed. <br /> <br />Davidson suggested completely striking No. 7, "extended stay lodging facility," as it is not a use- <br />by-right. <br /> <br />Shonkwiler suggested that this be postponed until the March 7, 1995, meeting, after the Homestead <br />Village PUD.
