tap to serve property located west of S. 96th <br />Street and north of the STC property. The taps <br />will be used in conjunction with an RTD Bus <br />Service/Washing operation on the property. Mr. <br />Varra requests a 3/4" water tap and a sewer tap <br />that would be tied into Storage Technology <br />Co.'s system under a separate agreement. <br />Williamson responded to the request stating <br />that the applicable City Code provisions <br />provide for discretionary consideration by City <br />Council after reviewing past actions and the <br />City Attorney's understanding of how the City <br />has previously interpreted the Code. <br />Williamson suggested that Council may want to <br />consider some clarification in the code <br />allowing Council to determine what may be in <br />the best interests of the City. Staff is <br />suggesting that Council approve the outside <br />water tap subject to City requirements and <br />standards regarding sizing, connection and <br />billing and deny the sewer tap request. Staff <br />is also asking that Council direct staff to <br />submit a revised water and sewer tap policy <br />regarding outside requests. <br />One of the issues that Council discussed was if <br />an outside tap is allowed, what is the <br />incentive on the part of the property owner to <br />annex to the City. Franklin related both sides <br />of the annexation issue stating that although <br />there is a substantially higher rate for both <br />installation and service, the property remains <br />outside the City limits precluding the City's <br />ability to obtain property tax revenue. <br />Likewise, if the property is not in the city <br />limits, other city services do not have to be <br />supplied. There are outside taps on 96th <br />Street that were granted in 1979, yet at that <br />time, there were feelings that annexation was <br />not appropriate. However, for the past year, <br />the City has been attempting to get these <br />properties annexed. <br />Council expressed their concerns that if <br />property owners outside the City limits want <br />city water, they should annex. <br />Mayor Fauson moved and Sackett seconded to <br />approve the outside water tap subject to City <br />requirements. By Roll Call Vote, the motion <br />was denied 5-1 with Mayor Fauson voting yes. <br />10 <br />
