instead of at a staff level and try to forego a <br />court battle. <br />Mayor Fauson agreed, but felt it was important <br />that this Council discuss the facts and <br />chronology of the dispute in an executive <br />session prior to making any commitments. <br />Howard suggested that Superior should consider <br />"freezing" the legal action until both <br />Council's have an opportunity to look at the <br />issues involved. <br />Mr. McElroy stated that the litigation is a <br />result of Louisville's refusal to provide a <br />sewer tap that was requested by Superior. "We <br />have certain investments in the infrastructure <br />as far as the sewer is concerned in Superior <br />and we have debt service to provide on that <br />infrastructure. The litigation arose out of a <br />dispute over the sewer service contract as to <br />what particular parts of that meant. What we <br />are trying to say, quite frankly, things are <br />different in Louisville now. We would like to <br />work together instead of getting into court. I <br />think we can just sit down and talk about it. <br />We owe it to our taxpayers to at least try." <br />Howard stated that he is not asking Superior to <br />drop the suit, he is only asking that it be <br />temporarily suspended to investigate the <br />possibilities Mr. McElroy has suggested. <br />Mr. McElroy suggested that Superior may be <br />willing to ask for a continuance. <br />Davidson stated that he is encouraged by a <br />willingness to cooperatively explore a way to <br />settle the dispute and would agree that an <br />executive session is necessary. Davidson asked <br />if it would be appropriate to appoint a <br />committee at this time. <br />Mayor Fauson felt it more important to have an <br />executive session first. <br />Carnival concurred stating that the implication <br />being heard tonight is that Louisville has been <br />uncooperative. "I think we have been trying <br />for quite some time to bring this to closure <br />rather than seeing it go to litigation. To <br />change that at this point without bring the <br />rest of the Councilpeople up to the same speed <br />is not the approach we need to take.
