Szymanski asked if there was some way the <br />city could be released from the liability if <br />something did happen to the water. <br />Williams stated we can provide an agreement <br />with an addendum clause wherein the <br />homeowners would hold the city harmless, but <br />this is not always guaranteed. <br />Hornbostel asked if at some point in time if <br />they want to annex can they annex to someone <br />else if we are providing water? <br />Mayor Fauson stated he felt the agreement <br />would state that. If they were to annex, <br />annexation would go to the provider of water. <br />Sackett moved and Mayor Fauson seconded to <br />authorize city staff to prepare a contract <br />with the intent that the city would be <br />willing to provide a 1" tap and provide a <br />tap fee for outside service rates. By Roll <br />Call Vote the motion passed 5-1, with <br />Davidson voting no. <br />Carnival rejoined the meeting. <br />OTHER <br />Carnival, representing the Finance Committee <br />asked that Phare make a background <br />presentation to Council. <br />Phare said that not included in South Boulder <br />Road Project were street lights. We were <br />hoping that some development would occur <br />before we needed lights. We did discuss with <br />the finance committee to provide funds from <br />the Capital Improvement Program from the fund <br />balance carry over in the amount of $15,000. <br />This would be put together with the $10,000 <br />currently budgeted and allow construction of <br />street lights on standard steel poles on the <br />south of South Boulder Road. At this time we <br />are not recommending street lights on the <br />north side because we still feel there is an <br />opportunity yet that development might occur <br />and the street lights would then be part of <br />the development. It was the Finance Committee <br />recommendation to allow staff to proceed with <br />that and then formally present a budgeted <br />amendment in the future. <br />Davidson asked why are street lights needed <br />11 <br />
