Incident Report — Henry's — 12/13/14 <br />Police responded to a report of a theft at the establishment. <br />Tennessen noted he was concerned since there had been a report about this <br />establishment at the last meeting. <br />Machado said there had not been a show cause hearing for this establishment <br />for some time although there had been some incident reports reviewed by the <br />Authority. <br />Hughes questioned if the report noted any alcohol service to the person accused <br />of the attempted theft. Authority members agreed there was no indication of <br />service. <br />Authority Attorney Culley reminded the Authority of the duty of establishments to <br />report and noted there may not be enough information to indicate the <br />establishment was even aware of the incident. The patron reported the theft to <br />the police. <br />Machado expressed concern over the number of reports involving Henry's but <br />did not feel this one indicated an order of show cause hearing. He asked about <br />the procedure for ordering a show cause hearing in general and asked about the <br />Authority's right to ask for intermediate fact finding. <br />Tennessen noted it did not hurt to send letters to let establishments know the <br />Authority is paying attention. <br />Machado noted the Rules of Procedure ask for a letter to be sent to an <br />establishment if an order to show cause vote is taken, but not passed. <br />Authority Attorney Gulley reviewed the Rules of Procedure in ordering a show <br />cause. After reviewing a police report, the Authority determines if the information <br />received and if substantiated could be grounds for suspension or revocation of a <br />liquor license. The Authority can ask the Police Department to do further <br />investigation. She noted if a show cause vote is not passed, a letter is an option. <br />Authority members discussed whether a letter should be sent concerning this <br />incident. They decided against a letter and not to take any further action. They <br />will be considering a report from this establishment at the next meeting. It was <br />tabled at the December meeting for further review in February. <br />C. Incident Report — La Revolucion — 12/20/14 <br />This incident involved a report of loud music from this establishment. <br />Authority members noted there was no liquor violation although there was a <br />disturbance due to the loud music. Authority members concurred no further <br />action needed to be taken. <br />Secretary's Report <br />
