Lathrop did not find this request unreasonable. He supported the idea that the architectural relief and <br />variations that you get with side-loaded garages may be a real asset in this subdivision. <br /> <br />Davidson stated that the developer failed to properly write the covenants and there is nothing the City <br />can do about that. The builder or architect had the responsibility to look at the overall guiding City <br />documents to assure compliance. <br /> <br />Wood stated that the PUD could be amended site-specific providing specific setbacks for specific lots. <br />He felt it would be more appropriate to do a range of lots in a given area of the subdivision. <br /> <br />Davidson preferred to send this back to staff to come back with a recommendation of how side- <br />loaded garages could be done. <br /> <br />Levihn felt most of the lots could take a side-loaded garage and the variety would improve the <br />Meadows community. <br /> <br />Howard felt a 16' setback would fix all of the current problems. He wanted to fix the minor <br />compliance problem now, have staff give Council a reasonable number (possibly 16'), changing as <br />little as possible to fix the current problem. <br /> <br />Keany felt there needed to be some sight specific PUD adjustments that staff needed to crat~. Any <br />future houses in the development needed to be in compliance completely. <br /> <br />Mayer did not like the Council having to act as a pseudo Board of Adjustment. He did not feet they <br />should be making specific changes to a PUD. <br /> <br />Davidson moved that Council continue Resolution No. 37, Series 1995, to the July 6 Council meeting <br />and allow staffto bring back a proposal to allow some variance in housing and side-loaded garages <br />in some locations. Seconded by Howard. All in favor with Sisk being excused. <br /> <br />RECESS <br /> <br />Davidson called for a five minute recess. <br /> <br />Council returned from recess. <br /> <br />DISCUSSION/DIRECTION PRELIMINARY SUBDIVISION PLAT AND PUD <br />DEVELOPMENT PLAN FOR HOME DEPOT <br /> <br />Paul Wood, Planning Director, stated that the home improvement center would be located south of <br />Dyer Road, immediately west of Colony Square (Mann Theaters). The store and garden center are <br />a total of 129,235 s.f., with a building coverage of just under 26% on the 10.95 acre parcel. The <br />PUD showed 538 parking spaces.
