Jon Lee, Bellock Construction, 1400 - 28th Street, Boulder, Colorado, stated that they have been <br />excluded from the Cherryvale Fire Department. They have put their inclusion papers into the <br />Louisville Fire Department, which is part of the Annexation Agreement. <br /> <br />Sisk moved that Council refer the annexation request and the preliminary Subdivision Plat and PUD <br />to the Planning Commission with Council comments. All in favor. <br /> <br />ORDINANCE NO. 1193, SERIES 1995 - REPEALING AND RE-ENACTING CHAPTER <br />17.68 OF THE LOUISVILLE MUNICIPAL CODE, ADDING REGULATIONS <br />PERTAINING TO OIL AND GAS FACILITY DEVELOPMENT, REGULATION OF USES <br />ADJACENT TO OIL AND GAS WELLS, AND AMENDING CERTAIN SECTIONS OF <br />CHAPTER 8.24 AND 17.16 - 1ST READING - SET PUBLIC HEARING 6/24/95 <br /> <br />Griffiths read by title only Ordinance No. 1193, Series 1995, "An ordinance repealing and reenacting <br />Chapter 17.68 of the Louisville Municipal Code, adding regulations pertaining to Oil and Gas facility <br />development, and regulation of uses adjacent to oil and gas wells and amending certain sections of <br />Chapter 8.24 and 17.16 in conformance therewith." <br /> <br />Paul Wood, Planning Director, explained that this ordinance is patterned after other jurisdictions that <br />have recently adopted oil and gas figs. Oil & gas wells, if authorized, would be allowed in all zoned <br />districts subject to approval of a Special Review Use. This ordinance would provide a number of <br />specific application requirements and its own review criteria in Section 90 of the Code. There would <br />be a six month time frame on the drilling. Setbacks for the drill location would be 350' to any <br />occupied structure or 75' to a fight-of-way. It would be subject to State Statutes noise mitigation. <br />The production site will be fenced to the height of the accessory equipment, excluding the vent <br />structures on the equipment. Planning Commission approved this on May 11, 1995. <br /> <br />Davidson called for Council comments or questions. <br /> <br />Mayer wanted a 650' setback from structures, if possible. <br /> <br />Sisk asked if any of the ordinance provisions had been tested. <br /> <br />Susan Griffiths, City Attorney, stated that the format was based on the Broomfield ordinance, with <br />some provisions from Thornton and other communities. In checking with the Colorado Municipal <br />League to see if there had been any court decisions on any of the municipal ordinances since the three <br />appellate decisions came down, they were told there had not been any. <br /> <br />Howard moved that Council approve Ordinance No. 1193, Series 1995, oil and gas ordinance on first <br />reading, send out for publication, and set the public hearing for July 6, 1995.
